To become a resident of South Africa, you apply through the Department of Home Affairs (DHA) for either a temporary visa tied to a specific purpose (work, study, business, retirement, or joining family) or, once you meet the longer-term criteria, permanent residency under the Immigration Act of 2002. Most people take the two-step route: enter on a temporary visa, then convert to permanent residency after five years of qualifying stay or another triggering event such as marriage to a South African citizen.
Temporary Visa or Permanent Residency
A temporary visa lets you live in South Africa for a fixed period tied to a purpose. You renew it periodically. It does not roll over into permanent residency automatically, and the type you hold shapes which permanent pathway opens later.
Permanent residency gives you the right to live and work in South Africa indefinitely without renewing a visa. It stops short of citizenship: you cannot vote and you cannot hold a South African passport.
Choosing the Right Temporary Visa
Seven categories cover most applicants. Pick the one that matches why you are going.
General Work Visa
For applicants with a confirmed job offer from a South African employer. The employer must obtain a certificate from the Department of Employment and Labour showing that no suitable South African citizen or permanent resident could be found for the role.1Embassy of South Africa. Requirements for General Work Visa Issued for up to five years.2Department of Home Affairs. General Work Visa Requirements
Critical Skills Work Visa
For professionals whose occupation appears on the DHA’s Critical Skills List (engineering, healthcare, IT, and others). A formal South African job offer is required; this is not a job-seeking visa.3VFS Global. Critical Skills Work Visa Checklist Your qualifications must be evaluated by the South African Qualifications Authority (SAQA) or the relevant professional body before you submit.4South African High Commission. Critical Skills Work Visa Valid for up to five years.
Study Visa
Requires an acceptance letter from a recognized South African institution and proof you can cover tuition and living costs. Valid for the length of the course. Work is not permitted unless the visa carries a specific endorsement for limited part-time employment.
Business Visa
For applicants establishing or investing in a South African business. The standard minimum investment is R5 million, confirmed by a chartered accountant’s certificate.5Embassy of South Africa. Requirements for Business Visa A reduced investment may be accepted in priority sectors. You need a viable business plan and a commitment to employ South African citizens or permanent residents.6Wesgro. Investor / Business Visa
Retired Person Visa
Requires proof of a guaranteed monthly income of at least R37,000 from a pension, irrevocable annuity, or assets.7Embassy of South Africa. Requirements for Retired Person Visa Employment in South Africa is not permitted. The visa is renewable, and the DHA describes it as intended for retirees planning limited or seasonal stays during its validity.
Spousal or Life Partner Visa
For applicants married to, or in a life partnership with, a South African citizen or permanent resident. The visa can be endorsed for work, study, or business. Documentation must show the relationship is genuine, such as a marriage certificate or evidence of a committed life partnership.
Relative’s Visa
For immediate family members of a South African citizen or permanent resident, such as parents, dependent children, or siblings. The South African sponsor must demonstrate a financial assurance of at least R8,500 per month per person.8South African High Commission. Relatives Visa That requirement does not apply where the sponsor is a dependent child. Valid for a minimum of 24 months and extendable.9Embassy of the Republic of South Africa. How to Qualify for Permanent Residency
Permanent residency is governed by Sections 26 and 27 of the Immigration Act. Section 26 covers “direct residence” pathways; Section 27 covers residency on other grounds such as extraordinary skills or business investment.
Five Years on a Work Visa (Section 26(a))
If you have held a work visa in South Africa for at least five consecutive years and have a permanent job offer, you can apply for direct permanent residency. The prospective employer’s chartered accountant must certify that the position exists and is intended for you, and the Department of Employment and Labour must confirm the salary and conditions match market rates.10South African Government. Immigration Act No. 13 of 2002 Time on an Intra-Company Transfer visa does not count toward the five years.
Five Years of Marriage (Section 26(b))
Available to spouses of South African citizens or permanent residents after five years of marriage. The DHA must be satisfied the spousal relationship is genuine. If the relationship ends within two years of the permit being issued, the permit lapses, except where a spouse has died.11Department of Home Affairs. Immigration Act 13 of 2002 (Amended)
Children (Section 26(c) and (d))
Children under 21 of a South African citizen or permanent resident qualify. A child granted this permit must apply for its confirmation within two years of turning 21, or it lapses. Children of citizens qualify regardless of where they live.10South African Government. Immigration Act No. 13 of 2002
Extraordinary Skills (Section 27(b))
The Director-General of Home Affairs may grant permanent residency to a foreign national who demonstrates extraordinary skills or qualifications to the department’s satisfaction.10South African Government. Immigration Act No. 13 of 2002 In practice, applicants generally need substantial post-qualification experience and documented professional achievements. Having a listed critical-skills occupation is not the same as being exceptional, and this is where most claims in the category fail.
Business and Retired Person (Section 27(c) and (d))
A foreign national who has invested the prescribed amount into a South African business and can show job creation and economic benefit may qualify for business-based permanent residency. Retirees who meet the R37,000 monthly income threshold used for the temporary visa can apply for permanent residency on similar grounds.12South African Embassy. Permanent Residence in South Africa
Relatives
Immediate family members holding a Relative’s Visa may apply for permanent residency at the DHA office nearest their South African address, provided they continue to meet the financial support criteria.8South African High Commission. Relatives Visa
Documents Every Application Needs
Regardless of category, the DHA expects a core document set. Missing or outdated paperwork is one of the most common reasons applications are refused.
- A valid passport with validity extending at least 30 days beyond your planned departure from South Africa and at least one unused page.13Border Management Authority. Entering and Leaving SA14Travel.State.Gov. South Africa Travel Advisory
- Police clearance certificates from every country where you have lived for 12 or more consecutive months since turning 18, within the five years before applying. Each must be no older than six months at submission.15South African High Commission in Ottawa. Basic Application Information and Requirements
- A medical report on the prescribed DHA form, completed by a registered medical practitioner and current within six months of application. The separate radiological (chest X-ray) report has been abolished.
- Proof of financial means, typically recent bank statements. The specifics vary by visa type.
- Two recent passport-sized photographs with a white or light background.
- The completed application form for your visa type, in black ink, with no corrections or white-out.
Each category adds its own documents on top: an employment contract for work visas, an acceptance letter for study visas, a marriage certificate for spousal visas, a chartered accountant’s certificate for business visas, and so on. Check the DHA or VFS Global checklist for your specific visa.
Where and How to Submit
If you are inside South Africa, applications go through VFS Global service centers. Outside South Africa, you submit at the nearest South African embassy, high commission, or consulate. Most locations require an appointment.
At the appointment you hand in documents, give biometrics, and pay the fees. Fees vary by visa type and country. South African missions charge in local currency; the South African Embassy in the United States, for example, lists a General Work Visa fee of $127.16Embassy of South Africa. Schedule of Fees VFS Global charges its own service fee on top of the DHA fee. Budget for both.
How Long It Takes
In early 2026, the DHA set turnaround targets of four weeks for Critical Skills Work Visas, eight weeks for General Work Visas, and eight weeks for Business Visas. Those are targets, not guarantees. Since the DHA centralized adjudication at head office rather than processing at missions abroad, actual times have run longer. Plan for 8 to 18 weeks on a temporary visa.
Permanent residency takes considerably longer. The official target is eight months; backlogs routinely push actual times to 12 to 24 months. If you are on a temporary visa that expires during that wait, keep it current. An expired temporary visa alongside a pending PR application creates avoidable complications.
If Your Application Is Refused
You have 10 working days from receiving the rejection notice to lodge an appeal under Section 8(4) of the Immigration Act. It goes to the Director-General of Home Affairs. If the Director-General upholds the refusal, a further appeal under Section 8(6) can be filed for review by the Minister of Home Affairs.
The most common refusal grounds are incomplete documentation, failure to meet financial thresholds, and inability to satisfy the job market test on a work visa. Fixing the application before submission is far more efficient than the appeal route.
Overstaying: Bans That Follow You
Under Section 30 of the Immigration Act and its regulations, a foreign national who stays past their authorized period is declared an “undesirable person.” Penalties scale with the length of the overstay:
- Under 30 days: barred from entering South Africa for 12 months.
- Over 30 days: barred for five years.
The bans also affect future visa and permit applications. If your visa is close to expiring and you are waiting on a renewal or a PR decision, apply for an extension before expiry. A pending application is treated far more leniently than an expired visa.
Keeping Your Permanent Residency
If you leave South Africa continuously for more than three years without a Retention of Permanent Residence Permit, your PR status may lapse. You could be refused entry or have residency revoked when you try to return. Extended time abroad is possible, but apply for the retention permit before you leave.
Otherwise, permanent residents have largely the same rights as citizens for living and working in the country. Voting and a South African passport are the main things reserved for citizens.
From Permanent Residency to Citizenship
After holding permanent residency and living continuously in South Africa for at least five years, you can apply for naturalization under Section 5 of the South African Citizenship Act.17SAFLII. South African Citizenship Act 1995 Beyond the residency requirement, you must:
- Be at least 18 years old.
- Be of good character.
- Intend to continue residing in South Africa.
- Communicate in at least one of the country’s 11 official languages.
- Have adequate knowledge of the responsibilities and privileges of South African citizenship.
- Hold citizenship of a country that permits dual nationality, or renounce your current citizenship if it does not.
The Minister of Home Affairs has discretion to waive the full residency requirement in exceptional circumstances.17SAFLII. South African Citizenship Act 1995 The dual-nationality condition catches many applicants late. If your home country does not permit dual citizenship, South Africa will require you to give it up before granting naturalization.
Tax Residency Is a Separate Question
Immigration residency does not automatically make you a South African tax resident, but the two often overlap. The South African Revenue Service (SARS) treats you as a tax resident if you meet either the “ordinarily resident” test (South Africa is your permanent home) or the physical presence test. The physical presence test requires more than:
- 91 days in the current tax year,
- 91 days in each of the five preceding tax years, and
- 915 days in total across those five preceding tax years.
South African tax residents are taxed on worldwide income, not only income earned inside the country. If you hold a temporary or permanent residency visa and spend significant time in South Africa, you likely qualify. Sort this out early. Discovering years later that your global income was reportable creates a problem that only grows more expensive with time.
