To cancel a Manhattan Club timeshare, your route depends on how long ago you signed. New buyers have an unconditional seven-business-day right to rescind under New York law. Everyone else is choosing among three realistic exits: the club’s internal surrender or deed-back program, a legal challenge based on defective disclosures (strengthened by the New York Attorney General’s findings against the developer), or a hardship negotiation with management. Each has its own cost, timeline, and credit implications, and none of them involve simply walking away from the maintenance bill.
If You Signed in the Last Seven Business Days
New York gives every timeshare buyer seven business days after signing the purchase contract to cancel for any reason, with a full refund. Weekends and holidays don’t count, so the real window is roughly nine to eleven calendar days. The right cannot be waived, and any document the developer put in front of you purporting to give it up is void.1Office of the New York State Attorney General. 13 NYCRR Section 24.3 – Timeshare Offering Plan Requirements
To use it, mail a written notice of cancellation, postmarked within the seven business days, to the sponsor or selling agent at the address printed on the cover of the offering plan. No explanation required. Once your notice is received, every dollar you paid must be refunded within 30 days, and any promissory note or financing instrument you signed must be returned in that same period.1Office of the New York State Attorney General. 13 NYCRR Section 24.3 – Timeshare Offering Plan Requirements
Check the execution date on your contract before assuming the window has closed. If you’re still inside it, send that letter by certified mail today. The rest of this article is for owners past the rescission period.
Deed-Back Through the Manhattan Club’s Surrender Program
The Manhattan Club has periodically run a surrender or transition program that lets owners deed their interest back to the association. When it’s open, this is the cleanest exit available. The club controls access, waitlists have been long, and the program can be paused or modified based on the association’s inventory and finances, so availability is never guaranteed.
Eligibility typically requires your account to be in good standing: maintenance fees, property taxes, and special assessments paid current, and any original purchase financing fully satisfied. If you still owe on a timeshare loan, the club won’t accept a deed-back until that balance is cleared. Expect a processing fee for title transfer and recording, plus administrative charges that you should confirm directly with owner services rather than taking a figure from a third party.
Owners facing genuine hardship may have options even when the standard program is closed. A documented medical condition that prevents travel, permanent disability, or a major income loss such as bankruptcy can sometimes qualify. Management reviews these requests individually and will ask for supporting evidence, like a physician’s statement or financial records. An approved hardship exit can release you from future obligations without needing to find a third-party buyer.
Call the Manhattan Club’s owner services department to ask whether the surrender program is currently accepting applications and what the specific requirements are. Get the answer in writing. Internal policies shift, and what a representative says on the phone may not match what’s actually available when your paperwork arrives.
A Legal Challenge Based on the Attorney General’s Findings
If you believe you were misled during the sales process, you have company. The New York Attorney General investigated the Manhattan Club and documented a pattern of deceptive practices: misrepresenting unit availability for owner reservations, overstating the exchange program’s value, falsely advertising the property as a luxury resort, misrepresenting the club’s financial stability, and using high-pressure sales tactics.2Office of the New York State Attorney General. Assurance of Discontinuance In the Matter of The Manhattan Club
Under the resulting settlement, affected owners who chose to relinquish their interests were entitled to have their contracts cancelled, be released from future maintenance fee obligations, and have related negative credit reporting removed or corrected.2Office of the New York State Attorney General. Assurance of Discontinuance In the Matter of The Manhattan Club If you bought during a period covered by the investigation and haven’t already received restitution, contact the Attorney General’s office to ask about eligibility.
Separately, New York law requires timeshare developers to file a detailed offering plan with the Attorney General before selling interests, under General Business Law Section 352-e and the implementing regulations at 13 NYCRR Part 24.3Legal Information Institute. New York Code 13 NYCRR 24.1 – General When a developer sells without a properly filed plan, or when the plan contains material misrepresentations, the purchase agreement may be voidable. Significant omissions or inaccuracies, like undisclosed liens, misrepresented fee structures, or false descriptions of the property, can support a claim years after the standard rescission window has closed.4New York State Senate. New York Code General Business Law 352-e – Real Estate Syndication Offerings
This is where the AG’s record becomes useful. The same categories of misrepresentation the state documented can anchor an individual rescission claim. An attorney experienced in New York real estate securities law can review your offering plan and sales file and tell you whether you have grounds. This route costs more and takes longer than a voluntary surrender, but it may be the only option when the internal program is closed or you don’t qualify.
Documents You’ll Need Before You Start
Whichever exit you pursue, you’ll need the same core file. Pulling it together before you call the club or an attorney saves weeks:
- Original purchase agreement, including any amendments or addenda.
- Recorded deed showing your ownership of the unit.
- Offering plan the developer provided at or before the sale.
- Most recent maintenance fee invoice confirming your current account standing.
- Loan payoff statement if you financed, showing the loan is satisfied or giving the current balance.
If the ownership is held in a trust or by multiple parties, every co-owner or legal representative must sign the surrender paperwork. When an original owner has died, you’ll need a death certificate; when an owner is incapacitated, a power of attorney authorizing the signer. The names on every document must match the deed records exactly. Discrepancies as small as a maiden name versus a married name cause processing delays.
The club’s owner services or transfer department issues the specific surrender application or deed-in-lieu form once you’ve started the process. The application typically asks for the unit number, original contract date, and the names of all owners as they appear on the deed.
Submitting and Tracking the Request
Send the completed package by certified mail with return receipt requested, or a courier service with delivery confirmation. You need proof of delivery. If the club later claims the paperwork never arrived, that tracking number is your defense.
Expect 60 to 90 days of review from the date the club receives your application, while legal and accounting verify that your account is clear and all paperwork is complete. Follow up every two to three weeks to confirm your file is still moving. Keep a written log of each call: date, name of the person you spoke with, and what they said.
Once approved, you’ll receive a draft deed-back to sign before a notary and return for recording. After the new deed is filed, the club should issue a final confirmation letter stating that your ownership interest has been terminated and no further financial obligations remain. Keep that letter permanently. It’s your protection if a billing error or collection attempt surfaces years later.
Credit and Tax Consequences of Exiting
A voluntary surrender is better for your credit than a foreclosure, but there are still edges worth understanding.
Timeshares used for personal vacations rather than as a rental investment are treated as personal-use property by the IRS. Any loss when you sell or surrender isn’t deductible on your federal return, the same rule that applies to a personal car or furniture.
When a developer or lender forgives debt you owe, such as unpaid maintenance fees or a remaining loan balance, the forgiven amount may count as taxable income. If the cancelled debt exceeds $600, the creditor must file a Form 1099-C with the IRS, and you’ll receive a copy reporting the forgiven amount as income.5Internal Revenue Service. About Form 1099-C, Cancellation of Debt That can produce an unexpected tax bill in the year you exit. If you were insolvent when the debt was cancelled, meaning your total debts exceeded your total assets, you may be able to exclude some or all of it by filing IRS Form 982.
On credit, a voluntary deed-back on a current account is far less damaging than a foreclosure. A timeshare foreclosure can drop a credit score by 150 points or more and stays on your report for seven years. A negotiated surrender with everything paid current may generate no negative entry at all, but this depends on how the developer reports the transaction. Ask the club in writing how they plan to report the surrender before you sign.
Why Not to Just Stop Paying
Some owners, worn down by the exit process, consider just stopping maintenance fee payments. In almost every case it’s the most expensive option in the long run.
Collection activity typically starts within a few weeks of a missed payment, beginning with letters and calls. Late fees and interest compound on the unpaid balance. Eventually, the association can begin foreclosure proceedings on your deeded interest. A timeshare foreclosure appears on your credit report for seven years. Even if the developer doesn’t report missed payments directly, foreclosures become public record and credit bureaus pick them up.
The club may also pursue a deficiency judgment for the gap between what your interest was worth at foreclosure and what you owed. If any portion of the debt is forgiven, you may receive a 1099-C for the cancelled amount, adding a tax bill on top of the credit damage.5Internal Revenue Service. About Form 1099-C, Cancellation of Debt Walking away trades a known cost for an unknown and usually larger one. If the surrender program feels too slow or too expensive, talk to a New York real estate attorney about your options before defaulting.
Avoiding Timeshare Exit Scams
The timeshare exit industry is full of companies that charge thousands upfront and deliver nothing. The Federal Trade Commission flags these warning signs:6Federal Trade Commission. Timeshares, Vacation Clubs, and Related Scams
- Upfront fees demanded before any service is performed.
- Guarantees that the company can get you out of your contract.
- Instructions not to communicate with your timeshare developer or resort.
- Advice to stop paying maintenance fees while they handle the “cancellation.”
That last one is the most dangerous. If you stop paying on an exit company’s advice, the club can begin collection and eventually foreclose, which damages your credit regardless of what you were promised. The exit company has no legal duty to protect your credit; you do.
Before hiring anyone, check their record with your state attorney general’s office and the Better Business Bureau. A legitimate attorney handling timeshare disputes typically charges by the hour or a flat fee for a specific service, not thousands upfront with vague promises about “working the process.” Claims of a special relationship with the Manhattan Club’s legal team or an insider exit channel are fabrications.
