How you cancel a Marriott Vacation Club timeshare depends almost entirely on how recently you signed. Within the first several days after purchase, state rescission law lets you walk away with a full refund by sending a written cancellation notice. After that window closes, your realistic exits narrow to Marriott’s own Exit Service Specialists, a licensed resale broker, or a negotiated deed-back, and all of them require your account to be current.
The Rescission Window Is the Cleanest Exit
Every state gives timeshare buyers a cooling-off period after signing. Length varies by state, from three calendar days in places like Indiana and Ohio up to fifteen days in Alaska. Marriott Vacations Worldwide is headquartered in Orlando and executes many of its contracts in Florida, so a large share of owners fall under Florida’s ten-calendar-day rescission period.1The Florida Legislature. Florida Statutes 721.10 – Cancellation
This right is absolute. Florida law states that no purchase contract can waive it, and any attempt by the developer to obtain a waiver is unlawful. If a closing happens despite a waiver, the buyer can void the transaction for up to one year after the original rescission deadline would have expired.1The Florida Legislature. Florida Statutes 721.10 – Cancellation
One catch worth knowing: the refund is what you paid, minus the value of any contract benefits you already used. If you booked a stay on your new points before canceling, the developer can deduct that portion.1The Florida Legislature. Florida Statutes 721.10 – Cancellation
If your contract was signed outside Florida, look at the rescission disclosure in your purchase documents. The contract is legally required to tell you how many days you have and where to send the notice. Miss the deadline and this exit disappears; the contract becomes a binding long-term obligation.
What Your Cancellation Notice Should Say
Your cancellation has to be in writing. A phone call to your sales rep will not preserve the right, and it leaves no proof if the developer later denies receiving anything. The letter should include:
- Contract or account number, taken from the first page of your purchase agreement.
- The full legal name of every buyer listed on the deed.
- The specific Marriott resort where the contract was signed.
- The purchase date, which shows you are inside the window.
- A single unambiguous sentence stating you are exercising your right to cancel the contract. No hedging, no “considering.”
- Signatures from every buyer on the original contract.
- A current mailing address for the refund and confirmation.
Keep it short. You do not need to explain why you changed your mind, and you do not need a lawyer to draft it. Check every name and number against the deed itself, because a typo can slow processing while the clock keeps running.
How to Send It
Mail the notice by USPS certified mail with return receipt requested. The return receipt proves the developer got it, and the postmark proves when you sent it. Under Florida law, a mailed notice is considered given on the date it is postmarked, not the date it arrives.1The Florida Legislature. Florida Statutes 721.10 – Cancellation That distinction matters if you are mailing on day nine of a ten-day window. Most other states follow the same rule; confirm yours in the contract.
Send it to the address in the “Notice of Cancellation” or “Right to Cancel” section of the contract. Not the front desk of the resort, not a general corporate address. A notice sent to the wrong department can be rejected, and by the time you fix it, the deadline may be gone.
Copy everything: the letter, the certified mail receipt, and the return receipt when it comes back. Store the copies apart from the original contract. If thirty days pass without written confirmation of the cancellation, follow up in writing and reference the certified mail tracking number.
Marriott’s Exit Service Specialists
Once the rescission window has closed, Marriott’s internal exit path is through its Exit Service Specialists team. The company acknowledges on its website that circumstances like declining health, reduced income, or fixed budgets can make ownership impractical, and it directs owners to a specialist to explore options.2The Marriott Vacation Clubs. Timeshare Exit
Marriott does not publish detailed eligibility on its public pages. The industry standard for developer deed-back programs is a fully paid-off timeshare loan and current maintenance fees with nothing past due. Owners still carrying a loan generally cannot surrender the deed until it is satisfied.
Approval is case by case, weighing current inventory levels, the specific resort or points package, and market demand. Not every applicant is accepted, and the process can run several months. You keep paying maintenance fees the whole time. Start late in the year and you can expect to owe the following year’s fees before the transfer finalizes.
To begin, log in to your owner account through the Marriott Vacation Club, Sheraton Vacation Club, or Westin Vacation Club portal and request a conversation with an Exit Service Specialist.2The Marriott Vacation Clubs. Timeshare Exit Going through the official channel matters. Third-party companies charge thousands for a process the developer may handle directly, and dealing with Marriott sidesteps the exit-scam industry entirely.
Selling on the Resale Market
If Marriott declines a deed-back, or if you want to recover some of what you paid, the secondary resale market is the other route. Marriott Vacation Club points trade actively on licensed resale platforms, but set realistic price expectations. Resale values are almost always a fraction of the sales-presentation price. Where you land depends on the resort, the point allotment, the annual maintenance bill, and whether the ownership is deeded or right-to-use.
Work only with a licensed real estate broker who specializes in timeshare resales and takes a commission after the sale closes. Legitimate brokers get paid when you get paid. A company demanding large upfront “listing” or “marketing” fees is the warning sign. The American Resort Development Association recommends getting all service terms in writing before paying anything and verifying the company’s real estate license with the appropriate state agency.
Resales can take months. You remain on the hook for maintenance fees until ownership formally transfers.
What Happens If You Just Stop Paying
Walking away without a formal exit is the worst option, even when the bills feel endless. The typical sequence:
- Late fees and penalties hit almost immediately after a missed payment.
- The unpaid balance goes to collections, which begins reporting the delinquency to credit bureaus.
- The developer or HOA can foreclose on the timeshare interest, judicially or non-judicially depending on the contract and state. A judicial foreclosure can produce a deficiency judgment if the sale does not cover what you owe.
- A foreclosure entry stays on your credit report for seven years and typically drops your score by 100 points or more, affecting mortgages, car loans, and credit cards for years.
Some owners bet that because the timeshare has little market value, the developer will not chase collections. It is a bad bet. Timeshare HOAs pursue delinquent fees aggressively because every non-paying owner shifts costs onto the rest. Even if a balance is eventually written off, the credit damage is already done, and a tax bill for cancelled debt can follow.
Taxes After a Timeshare Exit
Two common assumptions trip owners up: you probably cannot deduct your loss, and you may owe tax on forgiven debt.
No Deduction for a Personal-Use Loss
Federal law limits individual loss deductions to business losses, losses from profit-seeking transactions, and certain casualty or theft losses from federally declared disasters. A vacation timeshare you used personally fits none of those.3Office of the Law Revision Counsel. 26 USC 165 – Losses Surrender a $30,000 timeshare for nothing and the loss exists on paper only. It will not offset other income.
Cancelled Debt Can Be Taxable Income
If you owed on a timeshare loan and the developer forgives the balance through a deed-back, foreclosure, or settlement, the forgiven amount is generally treated as income. Any lender that cancels $600 or more of debt has to report it to the IRS on Form 1099-C.4Internal Revenue Service. About Form 1099-C, Cancellation of Debt Forgive $15,000 of your loan and the IRS treats that $15,000 as income to report.
There is one meaningful escape. If your total liabilities exceeded the fair market value of your total assets immediately before the debt was cancelled, you qualify for the insolvency exclusion and can exclude cancelled debt income up to the amount by which you were insolvent.5Office of the Law Revision Counsel. 26 USC 108 – Income from Discharge of Indebtedness Claiming it requires IRS Form 982 with your return. If a deed-back or foreclosure is coming, a consultation with a tax professional before the transfer closes is worth the fee.
Avoiding Exit Scams
The timeshare exit industry is riddled with fraud, and Marriott owners are a frequent target because the brand’s name recognition makes pitches sound credible. The Federal Trade Commission flags several warning signs:6Federal Trade Commission. Timeshares, Vacation Clubs, and Related Scams
- Unsolicited contact. A cold call or email offering to help you exit. Legitimate companies do not call you out of the blue.
- Large upfront fees. Thousands demanded before any work is done. Some companies simply contact Marriott on your behalf, which you can do for free.
- Guarantees to cancel your contract. No third party can guarantee a developer will accept a deed-back. Anyone who promises this is lying.
- Instructions to stop paying your mortgage or maintenance fees. This is designed to trigger a default the company then “resolves,” while your credit takes the hit.
Before hiring any exit company, search its name alongside “scam” or “complaint” and read what other owners report. Get every promise in writing and confirm any real estate license the company claims to hold. The simplest protection is to start with Marriott’s Exit Service Specialists before paying a third party. If Marriott cannot help, consult a real estate attorney licensed in your state rather than a company that found you through a cold call.6Federal Trade Commission.
