How to Complete and File a Notice of Appearance: Deadlines and Fees

To file a Notice of Appearance, download the correct form for the court hearing your case, complete the caption and your contact information exactly as they appear on the complaint, sign it, and submit it to the clerk — usually through the court’s electronic filing system — before your response deadline expires. In federal district court the standard form is AO 458, “Appearance of Counsel,” available on the U.S. Courts website.1United States Courts. Appearance of Counsel State courts publish their own templates through their clerk or judicial branch websites. The form itself is short. The consequences of getting it wrong, or skipping it, are not.

Find the Right Form for Your Court

Federal district courts use Form AO 458. Individual districts sometimes publish local versions with extra fields, so check the specific court’s website through the Federal Court Finder before printing anything.2United States Courts. Forms

Federal appellate courts use different forms. The Federal Circuit, for example, uses Form 8A for attorneys and Form 8B for unrepresented parties, and requires the entry within 14 days after a new case is docketed.3United States Court of Appeals for the Federal Circuit. Entries of Appearance

State courts publish appearance forms on their clerk of court or judicial branch websites. Illinois, for instance, offers a suite covering general appearances, limited-scope appearances, and jury demand requests.4Office of the Illinois Courts. Appearance and Jury Request Forms Before you download, confirm you have the right division — civil, criminal, family, or bankruptcy — because most courts use different forms or different captions for each.

Complete the Form Line by Line

The form is short, but the clerk uses every entry to route documents for the life of the case. Accuracy matters on each line.

  • Court identification. Enter the full name of the court, including the district or county. On AO 458 this reads “United States District Court for the __________ District of __________.”
  • Case caption. Copy the plaintiff and defendant names exactly as they appear on the complaint. Do not abbreviate or rephrase. Match the existing caption precisely.
  • Case number. Use the docket number from the upper right of the complaint or summons. If the case has not been filed yet, the clerk assigns one at filing.
  • Certification of authority. AO 458 includes a line certifying that the attorney is admitted or otherwise authorized to practice in that court and is appearing as counsel for a named party. Square away bar admission before signing this.
  • Contact information. Federal Rule of Civil Procedure 11 requires every pleading and paper to carry the signer’s address, email address, and telephone number. Fax is optional but often requested.5Legal Information Institute. Federal Rules of Civil Procedure Rule 11 – Signing Pleadings, Motions, and Other Papers
  • Bar number. AO 458 asks for the attorney’s printed name and bar number. Most state forms do the same so the clerk can verify the license.
  • Signature and date. Sign and date the form. Rule 11 requires the court to strike any unsigned filing unless the omission is corrected promptly.5Legal Information Institute. Federal Rules of Civil Procedure Rule 11 – Signing Pleadings, Motions, and Other Papers

Type the form when you can. If the clerk cannot read a bar number or email address, the filing may be rejected as technically deficient, and you will not receive electronic notices until the record is corrected. When several attorneys from one firm work the case, one is typically designated the primary contact, with additional counsel listed.

File It and Serve the Other Parties

Electronic Filing in Federal Court

Federal courts use the Case Management/Electronic Case Files system, known as CM/ECF, for electronic filing.6United States Courts. Electronic Filing (CM/ECF) You upload the completed form as a PDF, and the system timestamps it automatically.7PACER: Federal Court Records. How to File a Case

Filing through CM/ECF also serves every registered user in the case; no separate certificate of service is required for those parties, and service is complete the moment the document is filed unless you learn it did not actually reach the recipient.8Legal Information Institute. Federal Rules of Civil Procedure Rule 5 – Serving and Filing Pleadings and Other Papers Any party who is not a registered CM/ECF user still needs service by mail or another permitted method, plus a certificate of service.

Paper Filing in State and Local Courts

Some state and local courts still accept or require paper filings at the clerk’s window. Bring the original and at least one extra copy so the clerk can stamp one and return it for your records. Call ahead or check the court’s website for the required copy count.

Serve one copy on every other party or their attorney. First-class mail and hand delivery are the standard methods; many courts now allow email service if the parties have agreed to it in writing. Attach a certificate of service to your filed copy stating who you served, when, and how. That certificate is your proof if anyone later claims they were not notified.

Filing Fees

Fees depend on the court. Many federal courts charge no separate fee for a Notice of Appearance. Some state courts do charge an appearance fee, sometimes equal to or bundled with the initial filing or answer fee. Check the court’s fee schedule before you go, and bring a check or money order if the court does not take credit cards. Litigants who cannot afford the fee can usually apply for a waiver based on financial hardship.

Know the Deadline and What Happens If You Miss It

For defendants in federal civil cases, the clock is 21 days after being served with the summons and complaint to serve a responsive pleading.5Legal Information Institute. Federal Rules of Civil Procedure Rule 11 – Signing Pleadings, Motions, and Other Papers The Notice of Appearance usually accompanies or precedes that response. Appellate deadlines can be shorter — the Federal Circuit’s 14-day window is one example.3United States Court of Appeals for the Federal Circuit. Entries of Appearance State courts set their own deadlines, so consult the local rules of the court handling your case.

Doing nothing is expensive. Under Federal Rule of Civil Procedure 55, when a party who has been sued fails to plead or otherwise defend, the clerk must enter that party’s default.9Legal Information Institute. Federal Rules of Civil Procedure Rule 55 – Default; Default Judgment Once default is entered, the plaintiff can move for a default judgment, and the court can decide the case in the plaintiff’s favor, often without a hearing. Filing the appearance with a timely response is what prevents that.

Special Situations

Representing Yourself

You can file an appearance without an attorney. The right to appear pro se in a federal civil case comes from 28 U.S.C. § 1654.10United States District Court. Filing Without an Attorney / Pro Se The point of the filing is the same: it puts your mailing address and contact information on file so the court and other parties know where to send everything. If your address goes stale and you miss a deadline, the court will not treat that as an excuse. One boundary: corporations, partnerships, and other entities generally cannot represent themselves and must appear through counsel; the Federal Circuit states this outright.3United States Court of Appeals for the Federal Circuit. Limited Scope Appearances

Not every appearance covers the whole case. Many jurisdictions allow a limited scope appearance, in which the attorney handles a defined piece of the litigation — a single motion, one hearing, a settlement conference — and the client handles the rest. California addresses the practice in Rules of Court 3.35 through 3.37, and Illinois Supreme Court Rule 13 provides dedicated forms for entering and exiting these arrangements. After the defined task is done, the attorney can typically withdraw by oral motion or written notice, without the fuller withdrawal process a general appearance requires.11Office of the Illinois Courts. Limited Scope Representation

Out-of-State Attorneys

An attorney licensed in one state cannot simply file a Notice of Appearance in another state’s court. The attorney must first obtain pro hac vice admission — temporary permission to practice in that jurisdiction for a specific case — and almost every jurisdiction requires association with a local attorney already admitted to the court’s bar. The process involves a separate motion and a fee, commonly between $100 and $350. Some courts also cap how often an out-of-state attorney can use pro hac vice within a set period. If the visiting attorney signs or files documents before the pro hac vice motion is granted, some courts will strike those filings and may require return of fees earned in the case, so have local counsel sign and file until the admission order issues.12Cornell Law School. Getting Off the Record Later

Once your name is on the docket, you stay there until the court formally removes you. An attorney who wants out files a motion to withdraw, states the reason, and needs the judge’s approval. Courts scrutinize these motions because pulling counsel mid-case can prejudice the client, especially near trial. California’s procedure, tied to Code of Civil Procedure section 284, requires the withdrawing attorney to identify upcoming hearing dates and confirm the client has been notified.13Judicial Council of California. California Code of Civil Procedure 284 – Notice of Motion and Motion to Be Relieved as Counsel If the motion is granted and the client has no replacement counsel, the client becomes self-represented from that point forward.

Substitution is easier. The standard approach uses a form signed by both the departing attorney and the incoming attorney, filed with the clerk and served on the other parties.14Cornell Law School | Legal Information Institute. Substitution of Attorney Some courts process the substitution on the docket immediately, without a judge’s signature, because the client’s representation is not interrupted.
