An equipment rental damage waiver form is an add-on you sign with your rental agreement, at or before pickup, where the rental company agrees to cap what it can charge you if the equipment is accidentally damaged, lost, or stolen. Major rental companies market it as a Rental Protection Plan (RPP). It typically costs around 15 percent of the rental charges, limits your out-of-pocket exposure to a fixed amount per piece of equipment, and comes with a list of exclusions that can void it entirely. Fill it out at the counter or through the rental portal before the equipment leaves the yard, because you cannot add it later.
What You’re Actually Signing
A damage waiver is not insurance, and rental companies say so plainly in their terms. An insurance policy is a regulated product where an underwriter pays claims. A waiver is a clause inside your rental contract where the rental company voluntarily limits its own right to bill you for repair or replacement costs it would otherwise be entitled to recover.
Because the waiver lives inside the rental agreement rather than as a regulated product, the rental company decides whether the conditions were met. Herc Rentals, for instance, reserves the right to determine negligence “in Herc’s sole discretion.”1Herc Rentals. RPP Terms and Conditions Treat the form as a cost cap you buy, not a guaranteed payout.
What the Form Asks For and When to Sign It
The waiver is completed at the rental counter or through the company’s online portal when you reserve or pick up the equipment. Herc Rentals specifies that the RPP “may only be accepted at or prior to the commencement of the Reservation and Rental Contract.”1Herc Rentals. RPP Terms and Conditions Once the equipment leaves the yard without the waiver on the ticket, you cannot bolt it on afterward.
What you’ll provide:
- Your name or business name as it appears on your account with the rental company, along with a valid government-issued ID for verification.
- The equipment description, usually pre-filled from the rental company’s internal identification number and equipment type.
- The rental period, meaning the start and expected return dates that define the window the waiver is active.
- Your agreement to pay the waiver fee, calculated as a percentage of the rental charges. Sunbelt Rentals and United Rentals both charge 15 percent of gross rental charges for standard equipment.2Sunbelt Rentals. Rental Protection Plan Terms and Conditions3United Rentals. The fee is non-refundable and shows up as a separate line item on your invoice. You sign the waiver addendum alongside or as part of the main rental agreement, either with a wet-ink signature or a timestamped digital signature. Keep your signed copy and the receipt where you can find them.
One condition sits behind the signature that renters miss. Every major RPP requires you to “fully comply with the terms of the Contract” for the waiver to apply.2Sunbelt Rentals. Rental Protection Plan Terms and Conditions Your account also needs to be current at the time of an incident. Overdue balances can knock out coverage on their own.
Photograph the Equipment Before You Sign Off
This is not a field on the form, but it is the single most valuable thing you can do to protect yourself under the waiver you just signed. Before you drive or haul the equipment off the lot, walk around it and document what you’re taking.
Photograph every side, the undercarriage, tires or tracks, the operator cab, and any existing dents, scratches, or wear marks. Record the hour meter reading. Check the fluid levels. Confirm the machine matches what your rental agreement describes. If the rental company hands you a pre-delivery inspection form, fill it out thoroughly and keep your copy.
Timestamped photos with location data are your defense if the return inspector tries to attribute pre-existing damage to your rental period. Without that baseline, the rental contract generally presumes the equipment left the yard in good condition unless you proved otherwise at pickup.
What the Waiver Covers
A standard waiver covers accidental physical damage to the rented equipment and, in most cases, theft, provided you meet the reporting conditions. If a hydraulic line bursts during normal operation, or the machine takes a hit on a job site through no misuse, the waiver limits what the company can charge you.
The caps are modest by design. Sunbelt’s RPP limits your liability to 10 percent of the repair charges for accidental damage, capped at $500 per piece of equipment per incident. For lost or stolen equipment, the limit is 10 percent of fair market value, again capped at $500. Sunbelt also waives rental charges that would otherwise accrue while damaged equipment is being repaired or replaced.2Sunbelt Rentals. Rental Protection Plan Terms and Conditions United Rentals is structured similarly, waiving its right to collect amounts exceeding the lesser of 10 percent of replacement value, 10 percent of repair costs, or $500 plus applicable taxes.3United Rentals. Rental Protection Plan – US (English)
Those caps make the waiver most valuable on expensive equipment. On a $200-a-day excavator that takes $8,000 in accidental damage, a $500 out-of-pocket is a bargain. On a $50-a-day concrete saw, the math is thinner.
Exclusions That Void the Waiver
The exclusions list is where most renters get caught. Read it before you sign.
Misuse and Negligence
Operating beyond rated capacity, using equipment for something it wasn’t designed for, or filling a reservoir with the wrong fluid all void the waiver. Herc excludes equipment used “outside the intended purpose or exceeding Equipment’s rated capacity” and damage from “filling a reservoir with the wrong type of fluid.”1Herc Rentals. RPP Terms and Conditions Intentional abuse is universally excluded.
Tires, Tubes, and Tracks
High-wear parts stay your responsibility. United Rentals excludes tire and tube damage from “blow out, bruises, cuts, punctures or other causes inherent in the use of the Equipment.”3United Rentals. Rental Protection Plan – US (English) Herc extends that to tracks.1Herc Rentals. RPP Terms and Conditions Sunbelt covers tire repairs only up to $50 per tire; anything above that is on you.2Sunbelt Rentals. Rental Protection Plan Terms and Conditions
Acts of God and Environmental Hazards
Floods, storms, earthquakes, tornadoes, and fire damage are typically out. Herc also excludes damage from using earthmoving equipment in or around water, including wetlands, ponds, and rivers, and from working near fires or exposing equipment to corrosive materials.1Herc Rentals. RPP Terms and Conditions Sunbelt likewise excludes damage from “floods, water level changes, wind, storms, earthquakes or Acts of God.”2Sunbelt Rentals. Rental Protection Plan Terms and Conditions
Third-Party Property and Environmental Cleanup
The waiver applies to the rented equipment itself, and nothing else. If a rented machine leaks hydraulic fluid that contaminates soil, or a boom strikes a neighboring building, the cleanup and third-party property damage are your problem. Pollution, hazardous materials exposure, and damage to anything other than the rented unit fall outside the waiver.
Theft Without a Timely Police Report
Most waivers cover theft, but only with prompt reporting and documentation. Sunbelt requires a police report within 48 hours of discovery.2Sunbelt Rentals. Rental Protection Plan Terms and Conditions Herc requires the authorized operator to “promptly” file a formal written report with public authorities and deliver a copy to Herc.1Herc Rentals. RPP Terms and Conditions Leaving keys in unattended equipment is a separate Herc exclusion that can void theft coverage on its own.
If Something Goes Wrong
Speed matters. Herc requires notification within 24 hours of discovering damage or loss, along with a completed RPP Incident Report and cooperation with the company’s investigation.1Herc Rentals. RPP Terms and Conditions For theft, file the police report first, get the report number, then call the rental company with that documentation in hand. Miss the reporting window (48 hours at Sunbelt, “promptly” at Herc) and the theft protection is gone.2Sunbelt Rentals. Rental Protection Plan Terms and Conditions
During the rental itself, follow the manufacturer’s operating guidelines, secure the equipment when it’s not in use, never leave keys in an unattended machine, and let only authorized operators run it. Those aren’t just good practice. They’re waiver conditions.
Is the Waiver Worth Buying?
The waiver makes the most sense when you’re renting expensive equipment and don’t already carry commercial coverage on rented assets. If your business holds an inland marine policy or a commercial property policy that names rented equipment, check with your insurer before paying the 15 percent fee. You may already be covered. Some rental companies will drop the RPP requirement if you can provide a certificate of insurance listing them as an additional insured or loss payee.
For one-off or consumer rentals with no commercial coverage behind you, the waiver is cheap protection. A $500 cap on a $40,000 machine is straightforward math. Just read the exclusions, take the pre-rental photos, and hold on to the signed waiver and receipt in case a claim comes up.
