A compliance attestation form is a signed declaration that you or your organization meets a specific federal regulatory requirement, and to fill one out correctly you need to identify the right form for your industry, gather the evidence that backs up every statement on it, complete the fields using the official template, sign under the correct authority, and submit through the channel the regulator specifies. The signature is the part that carries legal weight: federal attestations are typically sworn under penalty of perjury, and a knowingly false one is a federal crime. Everything below is built around getting that signature onto a document you can defend.
Identify Which Attestation Form Applies to You
The form, the signer, and the submission channel all follow from the regulation. Four categories cover most federal compliance attestations.
Publicly traded companies file internal control attestations under Section 404 of the Sarbanes-Oxley Act. Management assesses the effectiveness of internal controls over financial reporting and states its conclusions in the annual report, and the registered public accounting firm independently attests to management’s evaluation.1U.S. Securities and Exchange Commission. SEC Proposes Additional Disclosures, Prohibitions to Implement Sarbanes-Oxley Act
Healthcare providers, health plans, and clearinghouses handle attestations tied to the HIPAA Privacy Rule. A frequent one is the reproductive health care attestation, where a party requesting protected health information signs a form stating the information will not be used to investigate or impose liability on anyone for seeking or providing that care.2U.S. Department of Health and Human Services. Model Attestation for a Requested Use or Disclosure of Protected Health Information Potentially Related to Reproductive Health Care
Engine and vehicle manufacturers attest to EPA that their products meet applicable emission standards. The agency issues a certificate of conformity based on that representation, valid for a single model year.3US EPA. Department of Defense contractors submit affirmations under the Cybersecurity Maturity Model Certification program, which entered Phase 1 implementation in November 2025. At Level 1, contractors self-assess annually against the 15 security requirements in FAR clause 52.204-21, enter results into the Supplier Performance Risk System, and submit an annual affirmation. Level 2 is more involved, but both tracks require an annual affirmation, and a missed affirmation causes the assessment to lapse.4Department of Defense Chief Information Officer. About CMMC
Gather Your Documentation Before You Start
Do not open the form until you have the records that back up every field. Discovering a compliance gap during preparation is manageable; discovering it after you have sworn to something is not.
You need the entity’s Taxpayer Identification Number or Employer Identification Number, which federal forms use to link the filing to the correct legal entity.5Internal Revenue Service. Taxpayer Identification Numbers (TIN) The legal name on the attestation must match the name on file with the relevant agency; a mismatch can trigger a rejection.
You also need to know who is signing. The attesting official is the person who accepts legal responsibility for the accuracy of everything on the form. For SOX attestations that is typically the CEO or CFO. For HIPAA attestations it may be a privacy officer or the party requesting the protected health information. The wrong signature can invalidate the entire filing.
The supporting evidence depends on the framework:
- Healthcare entities need documentation of employee training on privacy policies under 45 CFR 164.530, along with proof that administrative, technical, and physical safeguards are in place.6eCFR. 45 CFR 164.530 – Administrative Requirements
- Publicly traded companies need internal audit reports evaluating the effectiveness of controls over financial reporting, plus the external auditor’s attestation report.
- Defense contractors need self-assessment results scored against NIST SP 800-171, with each security requirement marked MET, NOT MET, or NOT APPLICABLE.7Department of Defense Chief Information Officer. CMMC Assessment Guide – Level 1
- Any regulated entity should have policy manuals, risk assessment logs, and corrective action records on hand.
Complete the Form Fields
Use the official template from the governing body: the SEC’s filing system, the HHS model attestation, or the SPRS portal for defense contracts. Older versions of a form may omit current regulatory references or use superseded language.
Most compliance attestation forms share the same structure: entity identification, the compliance period, the specific regulatory standard, and the declaration. Fill each field using the exact data from your preparation records. The certification period matters. If the form asks you to attest to controls for a fiscal year ending December 31, 2025, your supporting evidence must cover that same window. A common mistake is signing based on audit results from a prior period that no longer reflect the entity’s current controls.
The declaration section is where the form becomes a legal document. Federal attestations typically require the signer to declare under penalty of perjury that the information is true and correct. Under 28 U.S.C. § 1746, an unsworn written declaration subscribed as true under penalty of perjury carries the same force as a sworn affidavit.8Office of the Law Revision Counsel. 28 USC 1746 – Unsworn Declarations Under Penalty of Perjury Read the declaration carefully before signing. Some attestations cover only the specific data fields on the form; others sweep in all supporting documentation by reference. You need to know the scope of what you are certifying.
Signing Electronically
Most federal agencies accept electronic signatures. Under the E-SIGN Act, an electronic signature cannot be denied legal effect solely because it is in electronic form.9Office of the Law Revision Counsel. 15 USC 7001 – General Rule of Validity For the signature to hold up, the signer must intend to sign, the signature must be attributable to that specific person, and the signed record must be retained in a format that accurately reproduces the original. Portals like EDGAR and SPRS handle attribution through your login credentials. For standalone forms submitted by email or upload, use a signature method that creates an auditable trail linking the signature to the signer.
Submit Through the Correct Channel
Where you submit depends entirely on the regulator. SEC filers use EDGAR, the primary channel for filings under the federal securities laws.10Securities and Exchange Commission. Submit Filings Defense contractors enter self-assessment results and affirmations directly into SPRS. Healthcare attestations may be submitted to the requesting party or retained in the covered entity’s own files depending on the form.
If an agency still permits paper filings, send the form by certified mail with a return receipt requested. The receipt gives you proof of delivery and a timestamp you can point to if a dispute arises about whether you filed on time. Keep a complete copy of the signed form and all supporting documents before mailing the original.
Some frameworks allow extension requests for the filing deadline, but an extension to file does not extend your obligation to comply with the underlying standard. If your attestation is due and you are not actually in compliance, the extension only delays the paperwork.
What Happens After You Submit
Electronic submissions through portals like EDGAR produce an immediate confirmation of receipt. Paper filings may take weeks to be logged. A confirmation of receipt is not acceptance; it only means the agency has the document.
The agency may perform a desk audit, cross-referencing your attestation against other data. For SEC filings, that could mean comparing your internal control report against restated financials or whistleblower tips. For HIPAA attestations, the Office for Civil Rights may review complaint history. For CMMC, the Defense Contract Management Agency’s DIBCAC may independently verify assessment results for Level 3 contractors.4Department of Defense Chief Information Officer. About CMMC
If the agency identifies discrepancies, expect a request for additional documentation or a formal inquiry. Respond promptly and completely. Delays at this stage can escalate a routine review into a formal investigation.
Keep the Records
Signing and submitting is not the end of the obligation. HIPAA-covered entities must retain compliance documentation for six years from the date of creation or the date the document was last in effect, whichever is later.6eCFR. 45 CFR 164.530 – Administrative Requirements Under SEC rules, audit workpapers and records forming the basis of an audit or review of financial statements must be retained for seven years after the auditor concludes the engagement.11U.S. Securities and Exchange Commission. Retention of Records Relevant to Audits and Reviews Business formation documents, bylaws, and board minutes should be kept permanently.
Destroying records to obstruct a federal investigation is a separate crime under 18 U.S.C. § 1519, carrying fines and up to twenty years in prison.12Office of the Law Revision Counsel. 18 USC 1519 – Destruction, Alteration, or Falsification of Records in Federal Investigations Even outside an active investigation, premature destruction can leave you unable to defend your attestation if questions arise. When in doubt, keep everything for at least seven years.
What a False Attestation Costs
The broadest exposure comes from 18 U.S.C. § 1001, which makes it a crime to knowingly make a materially false statement in any matter within the jurisdiction of a federal agency. The penalty is up to five years in prison, or up to eight years if the false statement involves terrorism.13Office of the Law Revision Counsel. 18 USC 1001 – Statements or Entries Generally This statute applies to every type of compliance attestation submitted to the federal government.
SOX adds a second layer for corporate officers. Under 18 U.S.C. § 1350, a CEO or CFO who knowingly certifies a financial report that does not meet all statutory requirements faces up to $1,000,000 in fines and ten years in prison. If the certification is willful, the maximum fine rises to $5,000,000 and the prison term to twenty years.14Office of the Law Revision Counsel. 18 USC 1350 – Failure of Corporate Officers to Certify Financial Reports
HIPAA civil money penalties are tied to culpability and adjusted annually for inflation. As of 2025, the tiers run from $145 per violation for a “did not know” finding to a maximum of $2,190,294 per violation for willful neglect that is not corrected, with a $2,190,294 calendar-year cap per tier.15eCFR. 45 CFR Part 102 – Adjustment of Civil Monetary Penalties for Inflation
If You’re Being Pressured to Sign Something False
Federal law protects you if you refuse or report the problem. Section 806 of the Sarbanes-Oxley Act prohibits any company from firing, demoting, suspending, threatening, or otherwise discriminating against an employee who provides information about conduct they reasonably believe constitutes fraud against shareholders or a violation of SEC rules.16U.S. Department of Labor. Sarbanes-Oxley Act of 2002, Section 806 Protection applies when you report to a federal regulatory or law enforcement agency, a member of Congress, or a supervisor within your organization. A retaliation complaint goes to the Secretary of Labor and must be filed within 90 days of the retaliatory action. Remedies include reinstatement, back pay with interest, and litigation costs.
OSHA administers more than twenty additional whistleblower protection statutes, with filing deadlines ranging from 30 to 180 days depending on the specific statute.17Occupational Safety and Health Administration. OSHA Online Whistleblower Complaint Form Never sign an attestation you believe to be false. The signature is yours, the criminal exposure is yours, and the law gives you a path to push back.
