The Atlantis Bahamas waiver form is a digital assumption-of-risk release hosted on Smartwaiver that every guest must sign before using Aquaventure, the Dolphin Cay animal programs, or sports and adventure activities at the resort.1Atlantis Bahamas. Resort Terms and Conditions You can fill it out online before your trip or at a check-in kiosk when you arrive. Doing it ahead saves a slow morning in line behind families tapping through forms on tablets.
How To Complete and Submit the Form
The waiver lives on Smartwaiver, a third-party electronic signature platform. Hotel guests usually receive a link in their booking confirmation email, and day-pass buyers can reach it directly through the Atlantis event page on Smartwaiver.2Smartwaiver. Atlantis Bahamas Waiver Form The platform walks you through each section, captures a digital signature, and stores the record so staff can pull it up at check-in.
The form asks for your full legal name and date of birth as they appear on your government-issued ID, along with contact information. If you’re adding family members to the same submission, you’ll enter the same details for each person. The waiver itself is a legal release, not a health questionnaire, so you won’t be asked about medical conditions on the form.
If you’d rather handle it in person, digital kiosks at the check-in areas and the Aquaventure entrance load the identical form. Expect it to take longer on a busy morning. Day-pass guests should know that a completed waiver is one of four items required at check-in, alongside the confirmation email, photo ID, and the credit card used for the purchase.3Atlantis Bahamas Resort. Signing for Children and Others in Your Party
A parent or legal guardian must sign for any guest under 18. The Atlantis terms require the signer to represent that they have authority to sign on behalf of everyone they include.1Atlantis Bahamas. Resort Terms and Conditions A primary guest can list multiple family members on a single digital submission, which is the practical path for larger families.
Unrelated adults travelling together each need their own waiver. You cannot cover a friend or an adult relative on your form; each adult signs separately to keep individual legal accountability intact.
One boundary worth flagging before you book: if a child is traveling to the Bahamas with someone other than a parent, the Bahamas Department of Immigration requires a notarized letter from the child’s legal guardian authorizing the accompanying adult to travel with the minor and to seek medical care on the child’s behalf.4The Department of Immigration (The Bahamas). Guidelines for Minors Traveling to The Bahamas This is immigration paperwork rather than resort paperwork, but without it the child can be delayed or turned away at the border, and the Atlantis waiver becomes irrelevant. Notary fees for a single signature typically run $25 or less in the U.S.
What You’re Agreeing To
The core of the waiver is an assumption-of-risk clause. By signing, you acknowledge that water activities and animal interactions carry inherent dangers — slippery surfaces, strong currents, unpredictable marine life — and you accept those risks voluntarily. The agreement releases the resort and a list of affiliated entities, including Brookfield Hospitality, Marriott International, and several Bahamian operating companies, from liability for injuries arising from those known risks.1Atlantis Bahamas. Resort Terms and Conditions
Two provisions deserve a careful read before you sign.
The first is the governing-law clause. Any legal claim arising from events at the resort is governed by the laws of the Commonwealth of The Bahamas, and the Supreme Court of The Bahamas is the exclusive venue for any lawsuit. That means you cannot sue in a U.S. court, even if you’re an American citizen who bought your ticket from home.1Atlantis Bahamas. Resort Terms and Conditions
The second is the scope. The release covers ordinary negligence. Waivers of this type are generally enforceable for standard negligence claims, though courts in common-law jurisdictions tend to be more reluctant to enforce them when conduct crosses into recklessness or intentional harm. Bahamian courts follow English common law principles, but the precise boundaries of waiver enforceability in the Bahamas have not been extensively tested in published case law.
What the Waiver Doesn’t Do
Signing the form doesn’t override the physical rules at individual attractions. Atlantis enforces height minimums checked by staff at ride entrances: 48 inches for the main thrill slides (Surge, Falls, Drop, Serpent, Abyss, Leap of Faith, Challenger, and the Jungle slides); shorter riders are allowed on the Rapids and Current Rivers only if they can support themselves in the inner tube, with no infants or toddlers; and a 54-inch maximum on the Ripples Kids Pool and Poseidon’s Playzone children’s slides.5Atlantis Bahamas. Waterpark Rules and Regulations
The resort also publishes medical advisories separate from the waiver. The high-speed slides are not recommended for expectant mothers, people with physically limiting conditions, or anyone with a history of heart, neck, back, or joint problems.5Atlantis Bahamas. Waterpark Rules and Regulations Those advisories are posted at ride entrances and on the resort website; review them before you sign for anyone in your family who may be affected.
Finally, a signed waiver on its own doesn’t get you into the park. You still need a wristband, which must be worn at all times inside Aquaventure and is checked by staff throughout the day. Day-pass guests pick wristbands up at the Atlantis Adventures Desks or Ticket Center; hotel guests usually get them at their tower’s front desk or concierge. No wristband, no slides, rivers, or pools, regardless of waiver status.5Atlantis Bahamas. Waterpark Rules and Regulations
If You’re Injured at the Resort
The waiver shifts financial risk to you in ways that extend beyond the courtroom. Most U.S. domestic health insurance plans are not accepted by hospitals and clinics in the Bahamas, and Medicare provides no coverage abroad.6Squaremouth. Bahamas Travel Insurance: Plans and Prices An injury on a slide or during an excursion can mean out-of-pocket bills with no reimbursement path through your regular insurer. Emergency medical evacuations from the Bahamas can cost between $50,000 and $100,000, and providers often require upfront payment before transporting a patient.7VisitorsCoverage. Travel Insurance for the Bahamas: Guidelines, Visas and Tips A travel insurance policy with emergency medical and evacuation coverage is worth pricing out before the trip, especially given what the waiver takes off the table.
Signing the release does not eliminate every legal option. If an injury results from reckless conduct, willful disregard for safety, or an intentional act, the waiver’s protections may not hold up, because courts in common-law systems routinely decline to enforce liability releases in those circumstances. Any claim must be filed in the Supreme Court of The Bahamas under Bahamian law. The Bahamas Limitation Act of 1995 sets a three-year deadline: the action must be brought within three years of either the date the injury occurred or the date you became aware of it, whichever is later.8Government of The Bahamas. Limitation Act, 1995 After that, the resort has a complete defense. Three years sounds generous until you factor in the complexity of filing a foreign-jurisdiction lawsuit from the United States, so if you’re seriously hurt, speak with a lawyer familiar with Bahamian law early.
