How to Fill Out and Submit the Estes Claim Form

The Estes claim form is a one-page document you use to ask Estes Express Lines to reimburse you for freight that arrived damaged, short, or not at all. You can download it as a PDF from the Estes website or file the same information through the My Estes online portal. You have nine months from the delivery date to submit it, and once Estes has your paperwork, federal law gives the carrier 120 days to pay, deny, or make a settlement offer.

What the Form Covers

The form asks you to circle either “Loss” or “Damage,” but the situations behind those two words vary. Visible damage means crushed boxes, punctured pallets, or broken goods you can see at delivery; noting it on the delivery receipt before the driver leaves creates the paper trail the rest of the process depends on.

Concealed damage is different. The outside of the shipment looks fine, but the product inside is broken. You must notify the local Estes terminal within five days of receiving the shipment and request an inspection. Estes treats that five-day notice as a condition of recovery, so unpack anything you suspect was handled roughly right away.1Estes Express Lines. Claims Information

Shortages, where the piece count at delivery doesn’t match the bill of lading, and total loss, where Estes can’t locate the shipment at all, both use this same form.

Documents to Gather Before You Start

The form lists four categories of supporting documents that must accompany every submission:2Estes Express Lines. Form for Presentation of Loss and Damage Claims

  • The original bill of lading, which is the shipping contract establishing what was in the shipment and where it was going.
  • The original paid freight bill, showing that the transportation charges were paid.
  • A photocopy or certified copy of the vendor’s invoice, showing what the goods actually cost. Carriers reimburse actual value, not retail markup.
  • Repair invoices, if the goods can be fixed rather than replaced, covering parts, materials, and labor.

Photographs are not required but they help. Shoot the external packaging, the internal cushioning, and the damaged product from several angles. When the outer carton looks intact but the contents are broken, those photos support the argument that transit handling, not poor packing, caused the damage.

Federal regulations also let the carrier ask for more proof during its investigation. If the goods weren’t invoiced to the consignee on the bill of lading, or the invoice doesn’t show a price, Estes can require you to establish the destination value of the quantity shipped.3eCFR. 49 CFR 370.7 – Investigation of Claims

Filling Out Each Section

Start at the top with the claimant section: your name or company name, address, email, and a reference number for your own tracking. Enter the filing date and the total dollar amount you’re claiming.

Then fill in the shipper’s name and address, followed by the consignee’s name and address. The claimant may or may not be the same as either, depending on who is filing. Below those, enter the bill of lading number and date, then the Estes Freight Bill number and its date. The Estes Freight Bill number is printed on your freight bill and is what the claims team uses to pull up the shipment.2Estes Express Lines. Form for Presentation of Loss and Damage Claims

The middle of the form is where you describe what went wrong. For each item, list the number of articles, describe them, explain the nature and extent of the damage or loss, provide the invoice price, and state the claim amount for that line. Include the weight. If any of the freight is salvageable, note the disposition of salvage in this section.

At the bottom, check one of two boxes: whether the cargo was new in the manufacturer’s original packaging, or something other than new (used, rebuilt, refurbished, returned, a display unit, and similar). This affects how Estes values the goods. Sign and date before submitting.

Where to Send It

Estes recommends filing through the My Estes portal at estes-express.com. You’ll need to create an account, and once you do, the portal accepts digital uploads of your supporting documents and lets you track the claim after submission. The alternative is mailing everything to:1Estes Express Lines. Claims Information

Estes Express Lines
Attn: Claim Resolution Services

Richmond, VA 23060

Pick one method. Estes specifically warns against filing both online and by mail, because duplicate submissions slow processing rather than speeding it up. Questions before you file can go to Claim Resolution Services at (804) 353-1900, ext. 2030.

Filing Deadline

Every claim must be filed within nine months of the delivery date. For a total loss where nothing arrived, the nine months runs from the date the shipment should have arrived. This isn’t an Estes policy; federal law sets nine months as the shortest window a motor carrier can impose.4Office of the Law Revision Counsel. 49 U.S. Code 14706 – Liability of Carriers Under Receipts and Bills of Lading The Estes form repeats the deadline at the bottom of the page.2Estes Express Lines. After You Submit

Estes must acknowledge your claim in writing within 30 days of receiving it, unless the company has already paid or denied it in that same window.5eCFR. 49 CFR 370.5 – Acknowledgment of Claims

From there, the carrier has 120 days after receiving the claim to pay it, deny it, or make a firm written settlement offer. If the investigation takes longer, Estes must send a written status update at 120 days and every 60 days after that until the matter is resolved, and each update must explain the reason for the delay.6eCFR. 49 CFR 370.9 – Disposition of Claims

If you filed through My Estes, you can check status online without waiting for the formal notices. Approved claims typically result in a check mailed to the claimant. A denial comes with a letter explaining the carrier’s reasoning.

What Estes Will and Won’t Pay

Under the Carmack Amendment, codified at 49 U.S.C. § 14706, a motor carrier is liable for the actual loss or injury to property it transports.4Office of the Law Revision Counsel. 49 U.S. Code 14706 – Liability of Carriers Under Receipts and Bills of Lading “Actual loss” means the value of the goods themselves. If a shipment of parts arrives destroyed and your factory shuts down for a week waiting for replacements, Estes owes you for the parts, not for the lost production, missed sales, or contract penalties. Those indirect costs sit outside what the Carmack Amendment covers.

The claim amount on the form should reflect what you actually paid, supported by the vendor invoice. When items can be repaired for less than replacement cost, the carrier pays repair cost. Inflating the number beyond what your documents show is the fastest way to a denial or a reduced settlement.

If the Claim Is Denied

A denial letter isn’t necessarily final. Call Claim Resolution Services at (804) 353-1900, ext. 2030, to find out exactly why the claim was denied and whether more documentation would change the outcome.1Estes Express Lines. Claims Information Common reasons for denial include filing past the nine-month deadline, failing to report concealed damage within five days, insufficient documentation, or evidence that the shipper’s packing rather than the carrier’s handling caused the damage.

If informal resolution doesn’t work, federal law gives you at least two years from the date of the written denial to file a lawsuit. That two-year period runs from when the carrier gives written notice that it has disallowed any part of the claim.4Office of the Law Revision Counsel. 49 U.S. Code 14706 – Liability of Carriers Under Receipts and Bills of Lading Small claims court may be an option for lower-value shipments, depending on your jurisdiction’s dollar limits. For higher-value shipments where the denial looks unjustified, talking to a transportation attorney before that two-year window closes is worth considering.
