Gregory Maricle, et al., v. SouthState Bank, N.A. – Claim Form The settlement establishes a $1,500,000 fund to resolve claims tied to a February 7, 2024 breach that exposed personal information belonging to roughly two million people.2ClassAction.org. Maricle et al v. SouthState Bank NA Settlement Agreement A valid claim can bring up to $3,500 for documented out-of-pocket losses plus a proportional share of what remains in the fund.
Who Can File
You qualify if you live in the United States and SouthState Bank sent you a notice that your data was involved in the February 7, 2024 incident. The compromised information included names, dates of birth, addresses, telephone numbers, financial account numbers, and Social Security numbers, though not every category was exposed for every person.3SouthState Bank Data Settlement. Gregory Maricle, et al., v. SouthState Bank, N.A. Your notice will specify what types of information were affected in your case.
If you believe you were affected but never received a notice, email info@SouthStateBankDataSettlement.com to check whether you appear in the class database.

Miss the June 15 claim deadline and you forfeit your cash payment. You still get credit monitoring if you stay in the class, but the money is gone.
What You Can Claim
The claim form covers two kinds of cash benefits, and you can request both.
Documented Out-of-Pocket Losses up to $3,500
You can seek reimbursement for unreimbursed expenses tied to fraud or identity theft caused by the breach, up to $3,500 per person.1SouthState Bank Data Settlement. Gregory Maricle, et al., v. SouthState Bank, N.A. – Claim Form The loss must have occurred after February 7, 2024 and must be more likely than not caused by the breach. Qualifying expenses include:
- Overdraft, late, or declined-payment fees from fraud on your accounts
- Fees for identity-theft protection or credit monitoring you bought after the breach
- Costs to place or remove a credit freeze
- Fees paid to accountants, attorneys, or fraud specialists to resolve identity theft
- Costs to replace a driver’s license, passport, or other government ID
- Long-distance phone charges, postage, and notary fees connected to the breach
- Fraud losses directly traceable to misuse of the stolen information
Every expense needs documentation: bank statements, receipts, invoices, or police reports showing the date, the amount, and the connection to the breach.1SouthState Bank Data Settlement. Gregory Maricle, et al., v. SouthState Bank, N.A. – Claim Form Claims without paperwork are routinely denied. Gather your records before you start the form.
Pro Rata Cash Payment
You can also elect a proportional share of whatever remains in the $1,500,000 fund after documented-loss claims are paid.2ClassAction.org. Maricle et al v. SouthState Bank NA Settlement Agreement The per-person amount depends on how many valid claims come in. With roughly two million class members, the payment will be modest if participation is high, but the form takes only a few minutes.
Attorney fees, administration costs, and service awards to the named plaintiffs come out of the fund separately, so the pool available to class members will be smaller than the $1.5 million headline figure.3SouthState Bank Data Settlement. Gregory Maricle, et al., v. SouthState Bank, N.A.

Credit Monitoring You Get Without Filing
Every class member who does not opt out automatically receives one year of credit monitoring with one credit bureau plus $1,000,000 in identity theft insurance. No claim form is required.1SouthState Bank Data Settlement. Gregory Maricle, et al., v. SouthState Bank, N.A. – Claim Form You activate the service with a code sent by email or postcard after the court grants final approval.4SouthState Bank Data Settlement. Opting Out or Objecting
If you do nothing, you keep the credit monitoring but get no cash and give up your right to sue SouthState Bank on your own for anything related to this breach.3SouthState Bank Data Settlement. Gregory Maricle, et al., v. SouthState Bank, N.A.
To opt out, submit a written exclusion request by May 15, 2026. Opting out removes you from the settlement entirely, with no cash and no monitoring, but preserves your right to file your own lawsuit. To object without leaving the class, file a written objection by the same May 15 deadline; the judge will consider objections at the June 22 hearing.3SouthState Bank Data Settlement. Gregory Maricle, et al., v. SouthState Bank, N.A.
When Payments Actually Go Out
No money moves until the court issues final approval and any appeals are resolved, which can add months after the June 22 hearing.3SouthState Bank Data Settlement. Gregory Maricle, et al., v. SouthState Bank, N.A. Once the settlement becomes final, the administrator verifies each claim against the documents you submitted and sends payments. Keep your contact information current so your payment reaches you.
Are Settlement Payments Taxable
It depends on what the payment replaces. The IRS looks at the nature of the underlying claim: reimbursement for actual out-of-pocket financial losses generally is not taxable because it restores you to where you were, while payments for emotional distress or other non-physical harm typically count as taxable income.5Internal Revenue Service. Tax Implications of Settlements and Judgments The pro rata cash payment, which is not tied to a specific loss, may be treated differently from a reimbursement. If your payment is large enough to affect your return, talk to a tax professional about how to report it.
