How to Fill Out and Submit Your Maternity Leave Application Form

A maternity leave application form is what you submit to your employer’s HR department to request job-protected time off for pregnancy, childbirth, and recovery. Under the Family and Medical Leave Act, eligible employees at covered employers can take up to 12 workweeks of unpaid leave in a 12-month period for the birth and care of a newborn.1U.S. Department of Labor. Family and Medical Leave Act The paperwork itself is straightforward once you know three things: whether you qualify, which forms your employer accepts, and what your healthcare provider needs to certify. Give yourself enough lead time before your due date to gather all of it in one pass.

Confirm You Qualify Before You Fill Anything Out

FMLA protections only kick in when three conditions are all met. Your employer has to be covered: a private company with 50 or more employees in 20 or more workweeks during the current or prior calendar year, or a public agency, or a public or private elementary or secondary school regardless of size.2U.S. Department of Labor. Fact Sheet #28: The Family and Medical Leave Act

You must also have worked for that employer for at least 12 months. Those months don’t have to be consecutive, but employment before a break in service of seven or more years generally doesn’t count. And you must have logged at least 1,250 actual hours of work in the 12 months immediately before your leave begins. Paid time off, holidays, and other non-working hours don’t count toward that total.2U.S. Department of Labor. Fact Sheet #28: The Family and Medical Leave Act

One threshold catches people off guard: you have to work at a location where your employer has at least 50 employees within a 75-mile radius.2U.S. Department of Labor. Ask HR to confirm eligibility before you invest time in the forms.

Which Form You Actually Need

The Department of Labor publishes optional-use certification forms that many employers adopt as their standard templates. For maternity leave based on your own pregnancy and recovery, the form is the WH-380-E, the Certification of Health Care Provider for Employee’s Serious Health Condition.3U.S. Department of Labor. FMLA Forms The companion form, WH-380-F, is for leave to care for a family member with a serious health condition, which is what your partner would file if they were taking time off to care for you or the baby.

Both forms are free PDFs on the DOL website, including Spanish-language versions.4U.S. Department of Labor. Forms Some employers use their own proprietary leave request form instead of, or alongside, the DOL versions. Ask HR which template they require. Filling out the wrong one is the fastest way to get sent back to the start.

Gather This Before You Sit Down With the Paperwork

  • Your employee ID and job title, so HR can pull your records.
  • Your supervisor’s name and contact information, which some employer forms need for coverage planning.
  • Your expected due date, which anchors every other date on the form.
  • Whether your leave will be continuous or intermittent. Continuous leave is a single unbroken block. Intermittent leave covers absences taken in separate periods, such as prenatal appointments or pregnancy-related incapacity before delivery. Your employer must allow intermittent leave when it is medically necessary for prenatal care or a serious health condition, but leave taken after birth purely for bonding with a healthy newborn requires the employer’s agreement to be taken intermittently.5eCFR. 29 CFR 825.120 – Leave for Pregnancy or Birth
  • Your health insurance premium details. Your employer must maintain your group health coverage during FMLA leave on the same terms as if you were still working, but you remain responsible for your share of the premiums. If your leave is unpaid, the employer must give you advance written notice explaining how and when to pay them.6eCFR. 29 CFR 825.209 – Maintenance of Group Health Plan Coverage7U.S. Department of Labor. Filling Out the Leave Request

The employee portion of the application asks for the basics: personal information, type of leave, start date, expected end date, and whether you plan to use accrued paid leave concurrently. Be specific about dates. Vague ranges invite follow-up requests that stall the process.

Federal regulations require at least 30 days’ advance notice when the need for leave is foreseeable, and a pregnancy with a known due date is the textbook example.8eCFR. 29 CFR 825.302 – Employee Notice Requirements for Foreseeable FMLA Leave If circumstances change unexpectedly, whether complications, early labor, or bed rest, notify your employer as soon as practicable. The 30-day rule is not a permanent bar, but missing it without a good reason can push back the start of your protected leave.

The Medical Certification Section

The WH-380-E has two parts. You fill out the first with your identifying information. The second goes to your healthcare provider, whether an OB-GYN, midwife, or other licensed practitioner, who certifies the medical need for your leave. Your provider records the date your condition began, the probable duration of your incapacity, and whether you’ll need intermittent leave or a reduced schedule.

Your employer can ask for the certification at the time you request leave or within five business days afterward. You then have 15 calendar days from that request to return the completed form.9eCFR. 29 CFR 825.305 – Certification, General Rule If you miss that window without a good reason, your employer can deny FMLA protection for the gap between the expiration of the 15 days and the day you finally hand in a complete certification.10U.S. Department of Labor. Fact Sheet – Medical Certification Under the Family and Medical Leave Act Never producing the certification at all means the leave isn’t FMLA-protected. Book the provider appointment early enough that the form is ready to submit well inside the deadline.

The certification does not require your doctor to disclose your full medical history or private diagnostic details. The employer is entitled to the medical facts supporting the need for leave, the expected duration, and whether intermittent leave is medically necessary. Nothing more.

Submitting the Package to HR

Once the leave request and medical certification are complete, deliver them together to HR. How you deliver matters less than being able to prove you did. Reliable options include:

  • Your company’s HR portal. Most systems generate a timestamped confirmation on upload. Save or screenshot it.
  • Hand delivery. Drop the forms with your HR representative and ask for a date-stamped copy of the first page as your receipt.
  • Certified mail with return receipt if you are already out of the office. The receipt card documents the delivery date.

Keep your own copy of every page. If something goes missing in the company’s internal mail, that copy is the difference between a quick resubmission and starting over.

What Your Employer Must Do After You Submit

Within five business days of receiving your request, or five business days after learning that your absence may qualify, your employer must send you a Notice of Eligibility and Rights and Responsibilities.11eCFR. 29 CFR 825.300 – Employer Notice Requirements The notice tells you whether you meet the eligibility criteria. If you don’t qualify, it must state at least one reason, such as insufficient hours or a worksite below the 50-employee threshold.

If your certification is incomplete or insufficient, the employer must tell you in writing what’s missing and give you at least seven calendar days to fix it.12U.S. Department of Labor. Family and Medical Leave Act Advisor – Medical Certification – General Respond right away. Waiting until day six to call your doctor’s office cuts it too close. Once the certification clears review, you’ll get a written designation notice approving or denying the leave. Approval confirms your job status is protected for the duration.

Pay During the Leave

FMLA leave is unpaid. The law protects your job, not your paycheck. Two options can bring income in during your time off.

You can substitute accrued paid vacation, sick leave, or personal leave for what would otherwise be unpaid FMLA time. Your employer can also require you to use accrued paid leave concurrently with FMLA.13eCFR. 29 CFR 825.207 – Substitution of Paid Leave Either way, the paid leave runs at the same time as your FMLA entitlement and does not extend the 12 weeks. If you’re already receiving short-term disability benefits, the substitution rule doesn’t apply because the leave is considered paid. You and your employer can agree to top off disability with accrued leave to reach your full salary, but the employer can’t force it.

If your employer offers short-term disability coverage, it typically covers the physical recovery period after childbirth, roughly six weeks for a vaginal delivery and eight weeks for a cesarean section, with benefits usually around 60 percent of weekly earnings. Short-term disability requires its own form and its own certification from your doctor; the WH-380-E does not double as a disability filing. Ask your benefits administrator about the elimination period and any documentation deadlines.

More than a dozen states and the District of Columbia now run mandatory paid family and medical leave programs funded through payroll contributions. Benefit amounts and durations vary widely. If your state has such a program, you’ll likely need to file a separate claim with the state agency, and those benefits usually run concurrently with FMLA. Check your state labor department’s website for the specific application process, benefit amount, and any waiting period.

Returning to Work

When your leave ends, your employer must restore you to the same position you held before, or a virtually identical one with equivalent pay, benefits, and working conditions.14U.S. Department of Labor. Fact Sheet 28Q – Taking Leave from Work for the Birth, Placement, and Bonding with a Child Under the FMLA Before you come back, the employer may require a fitness-for-duty certification, a note from your healthcare provider confirming you’re able to resume your job. The certification can only address the specific health condition that caused your leave. If the employer wants it to speak to essential job functions, they must have given you a list of those functions no later than the designation notice.15eCFR. 29 CFR 825.312 – Fitness-for-Duty Certification

Schedule your postpartum checkup with enough lead time to have the note in hand before your planned return date. That avoids any first-day standoff over paperwork you could have handled a week earlier.
