To get a Ukrainian birth certificate and Apostille for use abroad, you complete three separate steps: order a new-format duplicate certificate from a Ukrainian Civil Registry Office (DRACS), have the Ministry of Justice of Ukraine affix an Apostille, and obtain a certified translation into the language of the country where you will use it. From outside Ukraine, the whole sequence runs through a Ukrainian consulate or embassy and realistically takes six months to a year under current conditions. The war has made every stage less predictable, so start as early as your deadlines allow.
Do You Actually Need a Replacement
Not every Ukrainian birth certificate qualifies for an Apostille. You need a new duplicate if any of the following applies:
- The certificate was issued before Ukraine’s independence in 1991. Soviet-era documents use an older format without modern security features and cannot be apostilled.
- The certificate has been laminated. Lamination prevents verification of security features and makes the document officially invalid.
- The certificate is damaged, or carries unauthorized stamps or markings.
- The certificate has been lost or stolen. A duplicate carries the same legal weight as the original.
If your certificate is post-1991, unlaminated, and in good condition, skip the replacement step and go straight to the Apostille.
What to Gather Before You Apply
Every application requires a copy of your valid passport.1Embassy of Ukraine in the United States of America. Requesting Vital Records Documents You will also need the year and location where the birth was originally registered so the registry office can find the archival record. If your name has changed since the original registration, include the marriage certificates or court orders that trace the change.
If you are requesting someone else’s certificate, submit documents showing your relationship, such as a birth or marriage certificate. If a representative in Ukraine will file on your behalf, they need a notarized Power of Attorney, and that Power of Attorney itself must be apostilled or receive consular certification and be translated into Ukrainian before it can be used in Ukraine.1Embassy of Ukraine in the United States of America. Three Ways to File the Application
Through a Ukrainian Consulate or Embassy
For applicants living outside Ukraine, this is the standard route. You submit your documents in person at the consulate or embassy, which forwards the request to the appropriate registry office in Ukraine.2Embassy of Ukraine in the Republic of Peru. Issuance of Extracts and Duplicate Certificates from the Civil Registry Some consulates will review your documents by email before scheduling the in-person appointment. Consulates can also bundle the Apostille with the duplicate request so both come back together.
In Person at a DRACS Office in Ukraine
If you or a trusted representative can go to Ukraine, you can apply at any DRACS office. The electronic register of civil status records is centralized, so you are not tied to the office that originally registered the birth. If the original record predates the electronic system and exists only on paper, the office has to retrieve it from the archival location, which adds time.
Online Through the Diia Portal
Ukraine’s Diia digital government platform lets citizens order duplicate civil status certificates online. You log in, select the certificate type, state the reason for reissuance, and choose either pickup at a DRACS office or delivery by Ukrposhta. You can also order certificates for relatives by uploading proof of the family relationship. This route works only if you can register on Diia and have a delivery address in Ukraine.
Fees and How Long It Takes
Costs depend on where you file and whether you bundle the Apostille. Through the Ukrainian Embassy in the United States:
- Duplicate certificate without Apostille: $20, paid by money order or cashier’s check to the Embassy.
- Duplicate certificate with Apostille: $50 to the Embassy plus a separate bank transfer of roughly 670 UAH (about $16 to $20) to the State Treasury Service of Ukraine.
Fees vary at other consulates.1Embassy of Ukraine in the United States of America. Requesting Vital Records Documents If you handle the Apostille separately inside Ukraine through the Ministry of Justice, the state fee for individuals is approximately 610 UAH.
Timing is where expectations often break. A duplicate drawn from an electronic record could, in normal times, be issued within days at a DRACS office. Paper archives take longer. From a consulate abroad, the Embassy of Ukraine in the U.S. estimates six months to a year for the full process.1Embassy of Ukraine in the United States of America. Requesting Vital Records Documents
The war disrupts these estimates. The Consulate General of Ukraine in New York warns that obtaining documents from Ukraine can take an indefinite period due to wartime conditions.3Consulate General of Ukraine in New York. Requesting Documents (Live Records)/Obtaining Duplicate Documents of Civil Registration and Extracts from Ukraine Registry offices in occupied or frontline areas may be unreachable, and some archives have been damaged or displaced. If the original registration was in one of these areas, expect substantial delays or the need for an archival search through alternative channels.
Getting the Apostille
An Apostille authenticates the signature and seal on a public document so a foreign authority will accept it. Ukraine and the United States are both parties to the 1961 Hague Apostille Convention, so a Ukrainian document with an Apostille is recognized in the U.S. without further legalization.4U.S. Department of State. For civil registry documents, the Ministry of Justice of Ukraine is the authority that affixes the Apostille.6HCCH. Ukraine – Competent Authority Only a post-1991 certificate in good condition qualifies, which is why the replacement step comes first when the original does not meet those conditions. If you bundled the Apostille into a consular application, the embassy handles this stage and returns the apostilled certificate to you. If you are working through Ukraine, you or your representative takes the certificate to the Ministry of Justice; normal processing runs five or more working days.
Certified Translation
An apostilled Ukrainian birth certificate is still in Ukrainian. Before a foreign authority will accept it, you need a certified translation covering the entire document, including the Apostille stamp. A qualified translator or recognized translation bureau does the work, and a notary certifies the translator’s signature. The notarization can happen in Ukraine or abroad through a Ukrainian consular office.
For U.S. immigration filings, USCIS requires that any foreign-language document be accompanied by a certified English translation. The translator does not have to be a court-certified interpreter, but they must include a signed statement that the translation is complete and accurate and that they are competent to translate from Ukrainian to English.
Translation of a one-page vital record typically runs $25 to $50 depending on the provider and turnaround. Ukrainian notarization adds a separate fee. Handling the translation and notarization through a consulate is convenient but slower.
If You Cannot Obtain the Certificate at All
USCIS accepts a birth certificate as primary evidence of birth, but federal regulations set out a hierarchy of alternatives when one is not available. You must first show that the certificate does not exist or cannot be obtained, then submit secondary evidence such as hospital records, baptismal certificates, or early school records that list your parents’ names and your date and place of birth.7eCFR. Title 8 CFR 103.2 – Submissions and Adjudications
If secondary documents are also unavailable, you can submit two or more affidavits from people who are not parties to the petition and who have direct personal knowledge of the birth. Affidavits sit at the bottom of the hierarchy. USCIS treats unavailability of a birth certificate as a presumption of ineligibility, so the burden is on you to overcome it with whatever documentation you can gather.7eCFR. Title 8 CFR 103.2 – Submissions and Adjudications
For applicants from conflict-affected regions where registry offices have been destroyed or are inaccessible, a letter from the Ukrainian consulate explaining the unavailability strengthens the record. Combine it with every corroborating document you have; the more records that line up with each other, the stronger your case.
