How to Get South African Citizenship Through Marriage

Marrying a South African does not make you a citizen. It opens a three-stage pathway: a spousal visa first, permanent residency after five years of marriage, then citizenship by naturalization after at least two more years of permanent residence in South Africa. That is the shortest realistic route to South African citizenship through marriage, and it takes seven years at a minimum. Nothing advances on its own. You apply and qualify at each stage.1LawLibrary. Immigration Act, 2002 – 26. Direct Residence

The Three Stages

South African immigration law treats the path from marriage to citizenship as a graduated process with checkpoints built in.

  • Spousal visa. A visitor’s visa under Section 11(6) of the Immigration Act. It lets you live in South Africa with your spouse and, with authorization, work or study. It stays valid only while the marriage is in good faith.
  • Permanent residency. Available once you have been married to a South African citizen or permanent resident for five continuous years and the relationship is genuine. Permanent residents can live and work in South Africa indefinitely.
  • Citizenship by naturalization. Available after you hold permanent residency and have lived in South Africa for at least two years while married to your South African spouse. This is the stage that produces a South African passport and voting rights.

Letting a visa lapse or missing a step can set the whole timeline back, so the sequence matters as much as the eligibility.

The Spousal Visa

The Section 11(6) spousal visa is a visitor’s visa with special provisions for spouses of South African citizens or permanent residents.2SAFLII. Immigration Act 13 of 2002 It is not a permanent right to stay. The Department of Home Affairs can revoke it if the relationship breaks down.

One rule catches people off guard. Once you qualify for permanent residency under Section 26(b), you are required to apply within three months.2SAFLII. Immigration Act 13 of 2002 You cannot sit on a spousal visa indefinitely after the five-year mark. The law expects you to move forward.

The spousal visa application requires a valid passport, two passport-size photos, form DHA-84, your marriage certificate, an affidavit confirming the spousal relationship, and evidence that you live together and share financial responsibilities. You also need a medical report on form DHA-811 (not older than six months), a chest X-ray report, and a police clearance certificate from the FBI or the equivalent authority in your home country.3Embassy of South Africa. Requirements for Visitor’s Visa Section 11(6) for Spouse of an SA Citizen or Permanent Resident If you apply from the United States, your South African spouse must provide a support letter and a copy of their ID.

Your South African spouse also has to demonstrate financial means of at least R8,500 per month per person, proven through recent bank statements stamped by the bank or a written confirmation from the institution.4Embassy of South Africa. Permanent Residency Through Marriage

When You Qualify

You can apply for permanent residency once you have been the spouse of a South African citizen or permanent resident for five continuous years.1LawLibrary. Immigration Act, 2002 – 26. Direct Residence The Director-General of Home Affairs must be satisfied the relationship is genuine. A marriage entered to gain immigration benefits is a criminal offence carrying up to eight years’ imprisonment for fraud, or up to fifteen years where fraudulent documents are involved.5LawLibrary. Immigration Act, 2002 – 49. Offences

Once granted, the permit carries a two-year probation. If the marriage ceases to exist in good faith within two years of the permit being issued, the permit lapses, unless the reason is the death of your spouse.1LawLibrary. Immigration Act, 2002 – 26. Direct Residence After the two-year window, your permanent residency survives a divorce.

What You Submit

The application uses form BI-947, which covers permanent residency under Sections 26 and 27 of the Immigration Act.6Department of Home Affairs. Application for a Permanent Residence Permit (BI-947) Alongside the form, you supply two recent passport photographs, your valid passport, your unabridged birth certificate, your marriage certificate (or proof of registration for a customary marriage), a medical report no older than six months, and a chest X-ray for applicants aged 16 and older (pregnant applicants are exempt).

Police clearance certificates are required for applicants aged 21 and older, from every country you have lived in for more than 12 months. Only originals from the issuing authority are accepted.6Department of Home Affairs. Application for a Permanent Residence Permit (BI-947) You also need proof of cohabitation (joint lease, shared utilities, and similar), a certified copy of your spouse’s South African ID, and financial evidence showing at least R8,500 per month per person.4Embassy of South Africa. Requirements for Relative’s Visa Anyone previously divorced must include all final decrees and any court orders on custody or maintenance, whether or not they have since remarried.

Where You Apply

Inside South Africa, applications go through VFS Global, which handles submissions for Home Affairs. You book an appointment and give biometric data (all ten fingerprints and a facial photograph) at the centre.7VFS Global. What Happens at the Visa Application Centre Outside South Africa, you submit through the nearest South African embassy or consulate. Fees change periodically, so confirm the current amount when booking. Keep your existing visa valid while the application is pending; letting it lapse creates a separate legal problem.

Citizenship by Naturalization

Once you hold permanent residency, you can apply for South African citizenship by naturalization under Section 5(5) of the South African Citizenship Act. The spousal route is more favorable than general naturalization. You must have been admitted for permanent residence, have lived in South Africa for at least two years immediately before the application, and have been married to your South African spouse throughout that period.8Embassy of South Africa. South African Citizenship – Section: South African Citizenship by Naturalization You also need to show good character and an intention to keep residing in South Africa.

The application uses forms BI-529 and BI-529E. You submit your permanent residency permit, proof of continuous residence, police clearance certificates, proof of financial stability, and your South African spouse’s ID. Applications inside South Africa are made at Home Affairs offices. The prescribed fee at South African embassies abroad is $25; domestic fees may differ.8Embassy of South Africa. South African Citizenship – Section: South African Citizenship by Naturalization On approval, you attend a citizenship ceremony, take the oath of allegiance, and receive your naturalization certificate. From there you can apply for a South African ID and passport.

What Happens If the Marriage Ends

The consequences depend on the stage you have reached.

On a spousal visa, the visa is valid only while the good-faith marriage exists. Divorce ends the visa, and you would need another basis to remain in South Africa.

For permanent residency, timing decides the outcome. If the marriage ends within two years of the permit being issued, the permit lapses.1LawLibrary. Immigration Act, 2002 – 26. Direct Residence After two years, a divorce has no effect on your status. The exception at every stage is death: if your spouse dies, the permit survives regardless of the two-year window.

Once you have citizenship, divorce is irrelevant. Citizenship is not conditional on the ongoing marriage.

Same-Sex Spouses and Life Partners

South African immigration law defines “spouse” broadly and includes parties to a permanent same-sex or opposite-sex relationship.2SAFLII. Immigration Act 13 of 2002 Legally married same-sex couples follow the same pathway described above.

If you are not married, you may still qualify for a life partner visa by showing a genuine permanent relationship of at least two years. That requires a notarial agreement setting out the terms of the relationship, proof of cohabitation and shared finances, and the same R8,500-per-month financial assurance from your South African partner. After five years in a recognized life partnership, you can apply for permanent residency on the same basis as a married spouse.9Embassy of South Africa. Grounds That Block Your Application

The Immigration Act designates certain people as “prohibited persons” who cannot receive any visa, admission, or residence permit. The disqualifying grounds include warrants or convictions (in South Africa or abroad) for genocide, terrorism, murder, torture, drug offences, money laundering, or kidnapping; carrying a prescribed infectious or communicable disease; prior deportation without formal rehabilitation by the Director-General; membership in an organization that advocates racial hatred or social violence or uses crime or terrorism to pursue its aims; and being found with a forged or falsified residence permit, passport, or identity document.10LawLibrary. Immigration Act, 2002 – 29. Prohibited Persons

These are absolute bars. No amount of relationship evidence overcomes a prohibited-person finding. If any of them may apply, get legal advice before starting.

If Your Application Is Denied

The Immigration Act provides a two-tier internal appeal. Within 10 working days of receiving the decision, you can apply to the Director-General for a review. If the Director-General upholds the denial, you have another 10 working days to escalate to the Minister of Home Affairs, who can confirm, reverse, or modify the decision.11Department of Home Affairs. Terms of Reference – Adjudication of Appeal Applications Submitted in Terms of Section 8(6) of the Immigration Act, 2002

Those windows are strict. Missing the deadline forfeits your right to appeal at that level, so track when each decision letter arrives.

Dual Citizenship

South Africa does not require you to give up your existing nationality when you naturalize. Whether you can keep it depends on your home country’s rules.

On the South African side, the Citizenship Act historically required citizens to apply for permission to retain their South African citizenship before voluntarily acquiring a foreign one. Failing to do so caused automatic loss.12South African Embassy in Washington DC, USA. Retention of South African Citizenship In May 2025 the Constitutional Court declared that automatic-loss provision unconstitutional and ruled that citizens who lost their South African citizenship under it are deemed never to have lost it.13SAFLII. South African Citizenship Act 88 of 1995 The practical effects are still working through. If you or your South African spouse may be affected, get current legal advice.

Processing Times

Permanent residency applications for spouses under Section 26(b) have a target processing time of about 12 months, but actual times vary with the completeness of your file and Home Affairs’ workload. Incomplete or incorrectly assembled submissions are the most common cause of delay. Having every document certified, current, and in the correct format before submission saves more time than anything else.

Citizenship applications through the spousal naturalization route generally take about four to six months at embassy level; domestic applications may take longer.8Embassy of South Africa. South African Citizenship – Section: South African Citizenship by Naturalization Throughout any waiting period, keep your existing visa or residence permit valid. Letting it expire while an application is pending can derail the whole process.
