If you want to join an Amazon class action lawsuit, the biggest live opportunity is the $2.5 billion FTC Prime settlement finalized in September 2025, which is paying eligible U.S. Prime subscribers up to $51. If you didn’t get an automatic payment in late 2025, you can file a claim at SubscriptionMembershipSettlement.com until July 21, 2026. For the several private class actions still pending against Amazon, there’s usually nothing to sign up for: U.S. class actions are opt-out, so qualifying customers are automatically included and receive a notice once a settlement is reached.
The Prime Settlement Claim: Who Can File and How
The $2.5 billion deal resolves FTC allegations that Amazon enrolled people in Prime without clear consent and made cancellation unreasonably difficult. Of that total, $1.5 billion is set aside for consumer refunds. Amazon neither admitted nor denied the allegations.1NPR. Amazon Prime Lawsuit FTC Settlement
To be eligible for a refund, you must meet all three of these criteria:2FTC. Amazon Refunds
- You were a U.S. Amazon Prime subscriber.
- You either signed up through one of the checkout flows the FTC identified as deceptive (the universal Prime decision page, the shipping selection page, single-page checkout, or the Prime Video enrollment flow), or you entered Amazon’s online cancellation process between June 23, 2019, and June 23, 2025, and were unable to complete it.
- You made limited use of Prime benefits. Automatic refunds went to people who used no more than three Prime benefits (including Prime Music or Prime Video) in any 12-month period after enrollment. The claims process ceiling is 10 benefits.
You don’t have to figure out which checkout screen you used. Amazon runs that analysis based on its own records.2FTC. Amazon Refunds
The Two Waves of Payment
The first wave was automatic. Between November 12 and December 24, 2025, Amazon sent payments to customers who met the tightest eligibility criteria, using PayPal or Venmo, or mailing a check if the digital payment wasn’t accepted within 15 days.3WBAL-TV. The second wave is the claims process, now open. Starting in January 2026, Amazon began sending claim notices by mail or email to eligible customers who didn’t receive an automatic refund. Each notice includes a unique claim ID and PIN. To file, go to SubscriptionMembershipSettlement.com, enter your credentials, and choose your payment method: check, PayPal, or Venmo.2FTC. Watch Out for Settlement Scams
The size of the payout has attracted scammers. Neither the FTC nor Amazon will ask you to pay a fee to receive a refund. Texts or emails promising “guaranteed refunds” or “special access” are not from the settlement administrator. Don’t click their links.4Snopes. Amazon FTC Settlement Notice

How Joining a Class Action Actually Works
One quick boundary. The Prime refund program is an FTC enforcement action, not a private class action, which is why the process is a claim filing rather than an opt-in to a lawsuit. For the other Amazon cases pending in 2026, the rules are different.
Most U.S. class actions are opt-out. If you meet the court-approved class definition, you’re automatically a class member. You don’t have to sign up, hire a lawyer, or take any action to join. If the case settles, you’ll receive a notice explaining how to file a proof of claim for your share. You’ll also be told how to opt out if you’d rather sue on your own, but opting out means giving up any settlement money from the class case.7Cornell Law Institute. Federal Rules of Civil Procedure, Rule 23
None of that happens until the court certifies the class, which often takes months or years after filing. Until then, there’s usually nothing to sign up for. The most useful thing you can do is monitor the case through the plaintiffs’ law firm or a case-tracking site.
Other Active Amazon Class Actions in 2026
Several other suits are in various stages. For each, the practical route to “joining” is either waiting for a class notice or registering interest with the filing firm.
- Subscribe and Save (Herman v. Amazon). Filed May 15, 2026, in the Western District of Washington. The proposed class alleges Amazon offers low introductory prices on recurring deliveries and then raises them, sometimes above what other sellers on the same platform charge. Named plaintiffs say their recurring coffee order rose from about $17 to nearly $29. Not yet certified; no claims process. - Tariff pricing (Rosen v. Amazon and Markland v. Amazon). Two related suits filed in May 2026 allege Amazon broke promises to absorb import tariffs and raised prices on consumer goods by more than 5%. Earliest stages, no certification. - Gender pay equity. Filed November 2023 in the Western District of Washington by Outten & Golden LLP. The suit alleges Amazon systematically underpays women and retaliates against those who complain.11Outten & Golden. Women File Landmark Equal Pay Class Action Against Amazon
- Unpaid onboarding (California). A California federal court certified a class in September 2025 for warehouse workers who say Amazon required 30- to 60-minute onboarding sessions, including welcome presentations and badge photos, without pay.12Carlson Attorneys. - Alexa privacy (Canada). A proposed national class action in British Columbia alleges Amazon collected more personal data from Alexa users than it disclosed and kept it indefinitely, even after users tried to delete it. Canadian residents who held an Alexa account between 2014 and July 19, 2023 can register at the Charney Lawyers website. Not yet certified.13National Post. For any of these cases, once a class is certified and a settlement is reached, eligible members receive a notice with claim instructions. Because most are opt-out cases, you don’t need to do anything now to keep your right to participate later.
