To request a furlough from jail, you submit a written application to your facility’s staff explaining an approved reason for temporary release, supported by documentation, and your unit team routes it through verification steps to the warden for a decision. In the federal system, 18 U.S.C. § 3622 gives the Bureau of Prisons authority to grant these releases for specific purposes like a family emergency, medical care not available inside, a job interview, or a court appearance.1Office of the Law Revision Counsel. 18 U.S. Code 3622 – Temporary Release of a Prisoner State and county jails run their own programs with similar logic but different forms and approval chains. Whether your request gets approved depends on why you’re asking, how much time you have left, and what your disciplinary record looks like.
What Counts as an Approved Reason
Federal law limits furloughs to specific purposes. Under 18 U.S.C. § 3622, the Bureau of Prisons may authorize a temporary release for you to:
- Visit a dying relative
- Attend a relative’s funeral
- Receive medical treatment that the facility cannot provide
- Contact a prospective employer
- Reestablish family or community ties in advance of release
- Participate in an education or training program in the community
- Appear in court for civil matters, grand jury proceedings, or criminal cases when requested by the court or prosecutor
The statute also includes a catch-all for “any other significant activity consistent with the public interest,” which gives wardens room to approve requests that don’t fit neatly into the listed categories.1Office of the Law Revision Counsel. 18 U.S. Code 3622 – Temporary Release of a Prisoner
Requests generally fall into two buckets. Emergency furloughs cover urgent situations that cannot wait, like a parent on life support. Routine furloughs cover everything else on the approved list and require more lead time and a stronger disciplinary record. A day furlough stays within the facility’s commuting area, runs 16 hours or less, and ends before midnight. An overnight furlough runs longer, usually three to seven days, though a warden may authorize up to 30 calendar days.2eCFR. 28 CFR Part 570 Subpart C – Furloughs
Who Qualifies
Matching an approved purpose is only the first hurdle. Your eligibility for a non-transfer furlough in the federal system depends heavily on how much of your sentence remains, following a sliding scale:
- Less than 90 days at your current facility: emergency furloughs only
- More than two years until release: emergency furloughs only
- Two years or less until release: emergency furloughs or routine day furloughs
- 18 months or less until release: emergency furloughs, routine day furloughs, or routine overnight furloughs within the commuting area
- One year or less until release: all furlough types, including overnight furloughs outside the commuting area
The closer you are to your release date, the more options open up.3Federal Bureau of Prisons. Federal Bureau of Prisons Program Statement 5280.09 – Inmate Furloughs
Reasons a Warden Will Ordinarily Deny
Even when you meet the time requirements, the warden will ordinarily deny a furlough if you were convicted of a serious crime against a person, if your presence in the community would attract significant public attention or diminish the seriousness of your offense, or if you’ve already been granted a furlough within the past 90 days.3Federal Bureau of Prisons. Federal Bureau of Prisons Program Statement 5280.09 – Inmate Furloughs
Behavioral Disqualifiers
Your disciplinary record can end the application before it starts. The BOP considers inmates inappropriate for furlough if they have a prior escape or attempted escape, have committed serious disciplinary infractions or drug- and alcohol-related violations within the past three years, have refused required drug treatment or educational programming, or have withdrawn from GED classes before completing them. Participation in the Inmate Financial Responsibility Program also matters; refusing to make payments consistent with your ability to pay can disqualify you.3Federal Bureau of Prisons. How to Submit the Application
The process starts with your unit team, the group of staff members assigned to your housing unit. You give them a written furlough request, and they review it for basic compliance with regulations and BOP policy. If you’re asking for a routine furlough, you’ll also complete a form authorizing withdrawal from your commissary account to cover the required urinalysis fee.
Each approved furlough requires a separate Furlough Application, Form BP-A0291. It captures the purpose of the release, your departure and return dates, the furlough address, an emergency contact, and your method of transportation.4Federal Bureau of Prisons. BP-A0291 Furlough Application
Several verification steps happen before your application reaches the warden. A member of your unit team contacts the person you plan to visit to confirm you’re welcome at the address. Staff send a Furlough Questionnaire to the U.S. Probation office in the district you’ll be visiting. The application also routes through the Institution Security Manager, who checks for any outstanding detainers or legal holds. If the probation questionnaire hasn’t come back within three weeks and staff have followed up, they can continue processing without it.3Federal Bureau of Prisons. One thing to know going in: if your unit team spots a clear reason for denial early, they can send an abbreviated memorandum to the warden recommending disapproval without completing the full application. A weak application dies fast. Getting the paperwork and documentation right the first time matters.
Documentation That Strengthens the Request
What you attach depends on what you’re asking for. Some examples:
- Medical furlough: records or a letter from a treating physician confirming the facility cannot provide the care you need
- Family emergency: a death certificate, hospital records, or a statement from a doctor treating your relative
- Employment or education furlough: letters from the prospective employer, program coordinator, or school
The strongest applications also include a concrete plan for travel and lodging: where you’ll stay, how you’ll get there, and who at the furlough address will be responsible for you. Vague plans are easy denials.
Who Pays
You do, or your family does. Federal regulation is explicit that transportation, food, lodging, and incidentals are the responsibility of the inmate, the inmate’s family, or another source the warden approves. The exception is when the furlough is primarily for the government’s benefit, in which case the Bureau covers costs.5eCFR. 28 CFR 570.34 – Expenses of Furlough For routine furloughs, you also prepay the urinalysis testing fee from your inmate trust fund before the application moves forward. A low account balance can stall the process.
Conditions You’ll Have to Accept
Before leaving, you must agree in writing to the conditions of release. A furlough is not freedom; you remain in BOP custody the entire time, and violating any condition can trigger escape charges. The main rules:
- Stay in your approved area and travel only to and from the facility
- No alcohol, marijuana, or controlled substances, and no visiting places where they’re sold or used illegally
- No medications except those prescribed by facility medical staff or a licensed physician
- No firearms or dangerous weapons
- No marrying, signing contracts, applying for loans, or conducting business without written staff approval
- No driving without written authorization, a valid license, and proof of insurance
- No associating with anyone who has a criminal record or is involved in illegal activity without written permission
- Immediate contact with the facility or your probation officer if you’re arrested, seriously ill, or facing any major problem
- No bringing items back to the facility that you didn’t leave with
The facility can add conditions specific to your situation.6eCFR. 28 CFR 570.38 – Conditions of Furlough Failing to return on time or breaking any other condition can be treated as escape. Under 18 U.S.C. § 751, escaping from federal custody carries a fine and up to five years in prison if the underlying custody was for a felony conviction, and up to one year if it was for a misdemeanor or pre-conviction arrest. These penalties stack on top of your existing sentence.7Office of the Law Revision Counsel. 18 U.S. Code 751 – Prisoners in Custody of Institution or Officer
If Your Application Is Denied
You’ll get written notice explaining the reasons for a denial. Your first recourse is the BOP’s Administrative Remedy Program under 28 CFR Part 542. It runs in stages: informal resolution at the facility, a formal written appeal to the warden, an appeal to the Regional Director, and a final appeal to the BOP’s General Counsel in Washington.8eCFR. 28 CFR 570.37 – Procedures to Apply for a Furlough
You must exhaust that entire administrative process before going to court. The Prison Litigation Reform Act bars any federal lawsuit challenging prison conditions until all available administrative remedies have been used.9Office of the Law Revision Counsel. 42 U.S. Code 1997e – Suits by Prisoners After exhausting the internal appeals, you or your attorney can file a petition in federal court. Courts can intervene when a facility’s decision doesn’t comply with its own regulations or applicable law, such as a medical furlough denied despite documented evidence of a life-threatening condition the facility cannot treat.
If You’re in a County or Local Jail
Everything above describes the federal system. If you’re in a county jail or local correctional facility, the rules come from state statute, county ordinance, or the sheriff’s office rather than the BOP, and the federal forms and time-remaining tiers do not apply to you. The core concept is the same, but authorization often looks different. In many jurisdictions a judge must approve the release rather than a warden, and work-release programs are sometimes handled on a separate track. Eligibility windows tend to be shorter at the local level, and the range of approved purposes may be narrower or broader depending on local policy. Start by asking your facility’s classification officer or case manager what temporary release programs exist and what forms are required. If your facility has no formal furlough program, your attorney may be able to petition the sentencing court directly for a temporary release order in an emergency.
