To sue Roblox, you generally have to go through arbitration, not a courtroom. The company’s terms of use require a written informal-dispute notice, then binding individual arbitration, and they waive your right to a jury trial or a class action. A traditional lawsuit is only realistic if you opted out of arbitration within 30 days of signing up, your claim fits a narrow carve-out like small claims court or intellectual property, or you have grounds to argue the arbitration clause itself is unenforceable. Confirm You’re Still Within the One-Year Deadline
Roblox’s terms impose a one-year contractual deadline on any claim related to the platform. If you don’t start your case within one year of when the claim arose, it is permanently barred.1Roblox Support. Roblox Terms of Use That is shorter than the statute of limitations most states apply to breach of contract, which typically runs two to ten years, so the contract clock is usually the one that matters.
Courts often enforce shortened contractual deadlines when a user agreed to the terms. A court could refuse to enforce it if the user was never meaningfully shown the terms or if state law forbids shortening the limitations period for that kind of claim, but you shouldn’t count on that argument. If your dispute is more than a few months old, sort out the deadline question before you spend anything else on the case.
Send the Mandatory Informal Dispute Notice
Before you can file for arbitration or in court, Roblox requires you to complete a Mandatory Informal Dispute Resolution process. Skip this step and Roblox can get your case dismissed or stayed on procedural grounds.
Send written notice by certified U.S. Mail or FedEx to Roblox Corporation, Legal Department, 3150 S. Delaware St., San Mateo, CA 94403. The notice needs to include your full name, Roblox username, and the email or billing address linked to your account; the name and contact information of your attorney if you have one; a description of the dispute and the resolution you want; and any case or ticket number from Roblox Support tied to the issue.
Once Roblox receives the notice, both sides have 60 days to confer in good faith and try to settle. Either party can ask for a phone or video call. What the Arbitration Clause Actually Takes Away
By using Roblox, U.S. residents agree that unresolved disputes go to individual arbitration rather than court. The terms are explicit: you waive the right to a judge or jury, and you waive any right to join a class action or class arbitration.1Roblox Support. Arbitration is a private process decided by a neutral arbitrator. It usually moves faster than litigation and is less formal, but it also limits what you can demand from Roblox in discovery, and the arbitrator’s decision is final with very narrow grounds for appeal. Challenging the clause itself is possible but hard. Courts occasionally strike arbitration agreements as unconscionable when the terms were buried or changed without notice, but in at least one federal case a court granted Roblox’s motion to compel arbitration after finding users were adequately notified. Most people who accepted the terms and didn’t opt out end up in arbitration.
The 30-Day Opt-Out Window
Roblox does let users opt out of arbitration, but the window is short. You have to send a written Arbitration Opt-Out Notice within 30 days of first signing up. If you missed the 30-day window, your only remaining path to court is arguing the clause is unenforceable, and courts have been unreceptive to those arguments when the opt-out was clearly available. If you’re setting up a new account, for yourself or a child, opting out immediately is the cleanest way to preserve the option to file in court later.
Small Claims Court as a Narrower Option
For lower-dollar disputes, small claims court can be a practical route. Many arbitration agreements used by large tech companies carve out an exception for small claims, so check the current Roblox terms to see whether the version you agreed to allows it.
Small claims dollar limits vary by state, typically $5,000 to $10,000, with some states going up to $25,000. You fill out a short complaint, pay a modest filing fee, and present the case to a judge without needing a lawyer. Filing a Civil Lawsuit

Your complaint has to establish the court’s jurisdiction, describe what Roblox did and how it harmed you, identify the legal theories supporting your claim, and state the relief you want. A vague complaint invites a motion to dismiss that can end the case before it starts. Roblox has experienced legal counsel, so the pleading needs to state viable claims tied to specific facts.
Federal courts hear cases involving federal questions or disputes between parties from different states with more than $75,000 in controversy. For smaller amounts or purely state-law claims, state court is usually the venue. Roblox is incorporated in Delaware and headquartered in San Mateo, California, which shapes where you can file.
Serving Roblox
After filing, you have to formally deliver the summons and complaint. Serving a corporation means delivering the documents to its registered agent. What Roblox Will File Back
Expect early motions. A motion to compel arbitration is almost guaranteed if you didn’t opt out; it argues the case belongs in arbitration and not in court. A motion to dismiss argues that even if everything you allege is true, you haven’t stated a valid legal claim. These motions can take months to resolve and often end the court case.
If the case survives, discovery opens up: written interrogatories, document requests, and depositions. Types of Claims That Actually Work

Proving these claims is hard because the terms give Roblox broad discretion to moderate and terminate. Privacy claims often involve children’s data. Consumer protection claims usually allege misleading advertising or nondisclosure around virtual currency and in-game purchases. State consumer protection statutes often allow statutory damages and attorney fees when deceptive conduct is proven. The core question is whether Roblox’s representations would mislead a reasonable consumer.
What You Can Recover, and What You Risk
Compensatory damages reimburse actual financial losses: the dollar value of deleted virtual items, unauthorized charges, or costs from a privacy breach. Document them with receipts, transaction histories, and a clear calculation. Courts don’t award round numbers based on how upset you are.
Punitive damages may be available if you can show willful misconduct or reckless disregard for your rights, but the bar is high and they aren’t available in every claim type. Some state consumer protection statutes provide fixed statutory damages and may allow the prevailing party to recover attorney fees.
Under Roblox’s terms, each side generally pays its own fees and costs.
