How to Write a Rescission Letter to Cancel a Contract

To write a rescission letter to cancel a contract, put the cancellation in writing, keep it short, and get it to the right address before your deadline expires. The letter needs your name, the contract date and number, a description of what you are canceling, a clear statement that you are exercising your right to cancel, the date, and your signature. Send it by certified mail with return receipt requested so you can prove when it arrived.

What to Put in the Letter

A rescission letter does not need legal language or a formal template. It needs to be unambiguous and specific enough that the recipient can locate your file and process the cancellation without guessing. If the seller gave you a cancellation form at the time of sale, you can sign, date, and mail that form instead of drafting anything new.

Otherwise, include these elements:

  • Your full name exactly as it appears on the contract
  • Your address and contact information
  • The contract date and the contract or account number
  • A description of the goods, services, or loan specific enough for the company to identify your file
  • A clear cancellation statement, such as “I am exercising my right to cancel this contract”
  • The date of the letter
  • Your signature

That is the whole letter. A few lines is enough. The goal is a document the company cannot reasonably misread or misfile.

What to Leave Out

You do not need to explain why you are canceling. The FTC Cooling-Off Rule and the Truth in Lending Act both give you an unconditional right to cancel qualifying contracts within the statutory window, and no justification is required.1eCFR. 16 CFR 429.1 – The Rule Offering a reason can work against you. Companies sometimes treat a letter full of grievances as a complaint rather than a formal cancellation notice, and that mischaracterization can delay or derail the refund.

Keep the tone neutral. Keep the content limited to the facts the recipient needs. Save the frustrations for a separate conversation if one is warranted.

How and Where to Send It

Under the FTC Cooling-Off Rule, you can cancel by mailing or hand-delivering a signed and dated written notice to the seller.1eCFR. 16 CFR 429.1 – The Rule Certified mail through the United States Postal Service with return receipt requested is not legally required, but it is the method that protects you. It generates a postmark, a tracking number, and a signed delivery receipt. If the company later claims it never received your notice, that paperwork settles the question.

Address the letter to the cancellation address listed in the contract. That address is often not the same as the billing address or the storefront where you signed. If no cancellation address is specified, use the seller’s place of business as identified in your paperwork.

Keep a complete photocopy of the signed letter together with the mailing receipt and the tracking confirmation. If the cancellation turns into a dispute, that paper trail is your evidence.

Email cancellation is risky unless the contract specifically permits it. A company that wants to fight your cancellation will look for any procedural flaw, and a physical letter sent by certified mail removes the opening.

Know Your Deadline Before You Send

Your right to cancel comes from a specific law, and each law sets its own clock. Confirm which one applies to your contract and count the days carefully.

FTC Cooling-Off Rule

This rule covers sales made away from the seller’s permanent place of business, including sales at your home, hotel conference rooms, fairgrounds, and temporary retail locations. The purchase must be at least $25 if the sale happened at your home, or at least $130 at another temporary location. You have until midnight of the third business day after the sale to cancel.2eCFR. 16 CFR Part 429 – Rule Concerning Cooling-Off Period for Sales Made at Homes or at Certain Other Locations Business days include every calendar day except Sundays and federal holidays, so Saturday counts. The deadline is based on when you mail the notice, not when the seller receives it. The letter must be postmarked before midnight of that third business day.3Federal Trade Commission. Buyers Remorse – The FTCs Cooling-Off Rule May Help

The rule does not cover vehicles bought from dealers, real estate transactions, insurance policies, securities and commodities sold by registered broker-dealers, or arts and crafts purchased at fairs.2eCFR. 16 CFR Part 429 – Rule Concerning Cooling-Off Period for Sales Made at Homes or at Certain Other Locations If the seller failed to give you a cancellation form at the time of sale, the three-day window may not have started running at all, so hold on to every piece of paperwork you received.

Truth in Lending Act

TILA gives you a three-business-day right of rescission on certain credit transactions secured by your primary home, including refinances and home equity lines of credit. It does not apply to the original mortgage you used to buy the home.4Office of the Law Revision Counsel. 15 USC 1635 – Right of Rescission as to Certain Transactions You must notify the creditor by midnight of the third business day following the later of consummation or delivery of the required disclosures and rescission notice.5Consumer Financial Protection Bureau. Regulation Z 1026.23 – Right of Rescission

If the creditor never delivered the required notice or material disclosures, the window stays open for up to three years after the transaction, or until you sell or transfer all your interest in the property, whichever comes first.5Consumer Financial Protection Bureau. Regulation Z 1026.23 – Right of Rescission

Timeshare Contracts

Timeshare rescission is governed almost entirely by state law. Windows typically run from 3 to 15 days depending on the state, and some states measure the period in hours rather than days. Whether the clock starts on the signing date or on the date you received all required disclosures also varies by state. Many state rescission periods are measured in calendar days rather than business days, so send the letter the same day you decide to cancel. Use the cancellation address designated in your contract, not the sales office you visited.

When There Is No Automatic Right to Cancel

If your contract does not fall under the FTC rule, TILA, or a state statute, you generally cannot walk away just because you changed your mind. A rescission letter can still be worth sending if the contract was formed under conditions that make it legally invalid:

  • Fraud or misrepresentation about a material fact
  • Duress or undue influence
  • Mutual mistake about a basic assumption underlying the deal
  • Lack of capacity, including minority or mental incapacity

A letter built on these grounds should identify the specific defect, demand that the contract be voided, and request a response within a reasonable period, often 10 to 30 days. The other party is not obligated to agree, and enforcing the rescission may require filing suit. The letter still matters because it creates a written record that you attempted to resolve the issue first, and that record can affect how a judge views the case. The legal standard for proving fraud or duress is high, so consulting an attorney before you send this kind of letter is usually worth the cost.

After You Send the Letter

Canceling under the FTC rule does not let you keep what the seller delivered. You must make any goods you received available to the seller at your home in substantially the same condition they arrived in. You are not required to ship them back at your own expense. If the seller does not retrieve them within 20 days of receiving your notice, you may keep or dispose of them.2eCFR. 16 CFR Part 429 – Rule Concerning Cooling-Off Period for Sales Made at Homes or at Certain Other Locations If you fail to make the goods available or agree to return them and do not follow through, you remain bound by the original contract. This is where some people lose their cancellation rights after mailing the letter on time.

On the seller’s side, the company has 10 business days from receiving your notice to cancel the contract, return any check you signed, refund all payments, and return any trade-in.3Federal Trade Commission. Buyers Remorse – The FTCs Cooling-Off Rule May Help Check your bank and credit card statements over that window to confirm the refund posts.

For a TILA rescission, the creditor has 20 calendar days after receiving your notice to return any money or property and release the security interest on your home.4Office of the Law Revision Counsel. 15 USC 1635 – Right of Rescission as to Certain Transactions You can hold on to any loan proceeds until the creditor meets those obligations.
