If My Husband Has Two Last Names, Do I Take Both?

If your husband has two last names, you do not have to take both. You can adopt the full compound surname, pick just one of the two, hyphenate one of his with your own, or keep your current name entirely. The Social Security Administration treats any of these as a valid marriage-based name change and accepts your marriage certificate as proof, as long as the new name can be derived from the names already shown on it.1Social Security Administration. Your Choices

Marriage itself does not change your name. It gives you the legal basis to change it if you want to. When your husband’s surname is something like “Garcia-Lopez” or “Lee Walsh,” four paths are open to you:

  • Keep your current name. No paperwork, no filings. Your legal name stays what it is.
  • Take both of his last names, hyphenated or not, exactly as they appear on his documents.
  • Take only one of his two last names. You choose which.
  • Hyphenate your name with one or both of his. If your name is Foster and his is Lee-Walsh, “Foster-Lee” or “Foster-Walsh” both work.

The SSA’s internal policy manual states explicitly that a spouse may take “one part of the other parties’ compound surname.” The manual’s own example: if Lisa Foster marries Bryan Lee-Walsh, she can change her name to “Foster Lee” with nothing more than the marriage certificate.1Social Security Administration. When the Marriage Certificate Is Enough

For almost any combination of your name and his two names, the marriage certificate alone will do the job. You write the name you want on the marriage license application before the wedding, and the issued certificate reflects it. Government agencies then accept the certified certificate as proof.2USAGov. A court-ordered name change becomes necessary only when the name you want cannot be derived from the names already on the marriage certificate. If you want to invent a brand-new blended surname that appears nowhere on the document, or if your state’s marriage license form doesn’t accommodate the arrangement you want, you’ll file a petition in court instead. Filing fees generally run from about $25 to $500 depending on the jurisdiction, and some courts require a hearing while others approve on paper. If all you’re doing is adopting one or both of your husband’s existing last names in some arrangement, you almost certainly won’t need any of that.

Start With Social Security

Your Social Security record is the foundation for every other name update. The IRS, your state motor vehicle agency, and the State Department all verify against SSA data, so your new name has to land there first.

Some people can request the change online. If the online option isn’t available for your situation, you’ll make an appointment at a local Social Security office or submit by mail using Form SS-5, along with your certified marriage certificate and proof of identity such as a current driver’s license or passport.3Social Security Administration. One detail catches people out when the husband’s name has a hyphen, a space, or an apostrophe: make sure the SSA record is spelled and punctuated exactly the way you want it to appear everywhere else. A missing hyphen or an extra space can trigger mismatches later when other agencies run a verification against SSA.

The Tax-Season Timing Trap

The IRS matches the name on your return against the name the SSA has on file for your Social Security number. If they don’t match, your return can be rejected or delayed and your refund held up.5Internal Revenue Service. Name Changes and Social Security Number Matching Issues

If you married late in the year and haven’t updated your name with the SSA before filing season, file under your former name. The IRS checks against whatever name the SSA currently shows, not the one you intend to use.6Internal Revenue Service. Changed Your Name After Marriage or Divorce Filing jointly doesn’t change the rule. Each spouse’s name on the return has to match that spouse’s SSA record.

If His Two Names Come From a Latin American Tradition

In many Latin American countries, two surnames are standard rather than optional. One comes from each parent, and both are part of a person’s full legal identity. If your husband’s two names reflect that tradition, the arrangement may carry legal weight in his country of origin even though U.S. agencies treat your choice as entirely up to you.

A few things worth thinking through if that applies to your situation. Some countries require that U.S. documents be translated and notarized before they’ll accept a name change, and a few may not recognize a change made solely through a U.S. marriage certificate. Keep several certified copies of the marriage certificate on hand for foreign paperwork. If either of you holds dual citizenship, the name on each country’s passport may need to be handled separately through that country’s own process, and keeping the names consistent across all your identification documents will save you trouble at border crossings.

Choosing Among the Options

There’s no legal preference for one choice over another, so the decision comes down to what you want your name to be and how much weight each of his two last names carries for him and his family. Taking both signals that you’re part of the whole family name as it stands. Taking one lets you join his name without carrying a surname that may run long on forms or get truncated in databases. Hyphenating keeps your own identity on paper. Keeping your name avoids the update process entirely.

Whatever you decide, write the exact name you want, with the exact spelling and punctuation, on the marriage license application. That single entry sets up every document that follows.
