An Interim Notice Authorizing Parole is the paper document U.S. immigration authorities issue to confirm that you have been granted parole into the United States under Section 212(d)(5)(A) of the Immigration and Nationality Act. It shows the date parole was granted, when it expires (or the event that ends it), and the conditions you must follow while you are here. It is proof of your temporary permission to be physically present in the country. What Your INAP Shows
The notice functions as a letter confirming a grant of parole. On its face you should find the grant date, the expiration date or triggering event, and any specific conditions attached to your parole. The Office of Refugee Resettlement recognizes the INAP as an acceptable document for establishing parole status for certain populations, including Afghan humanitarian parolees, which is often how it comes up when applying for benefits or services.2Administration for Children and Families. The INAP is not the only record of your status. After you arrived at a port of entry, you were also issued an electronic Form I-94 arrival record, which you can pull down from Customs and Border Protection’s I-94 website.3U.S. Customs and Border Protection. I-94 Website Together, the INAP and the I-94 are the core evidence you’ll present when applying for employment authorization, benefits, a driver’s license, or anything else that asks you to prove lawful status. Keep both. Print copies of the I-94 as well as the INAP itself.
Parole Is Not Admission
This is the single most important thing to understand about your document. The statute says plainly that parole “shall not be regarded as an admission of the alien.”1Office of the Law Revision Counsel. 8 USC 1182 – Inadmissible Aliens You are physically inside the United States, but for immigration purposes you have not been “admitted.” When the purpose of the parole is served, you are expected to return to the status you had before it was granted.
The Supreme Court reinforced this point in Leng May Ma v. Barber, 357 U.S. 185 (1958), holding that release on parole did not change an individual’s status as an excluded alien and did not bring the person “within the United States” for purposes of certain immigration benefits.4Justia. Leng May Ma v. Barber, 357 US 185 (1958) In practical terms, physical presence on parole does not open every door that presence after admission would. Some benefits and paths that require formal admission remain closed to parolees. Parole gets you through the door. It does not change your legal footing once you walk through it.
Your INAP Does Not Authorize You to Work
Being paroled into the country does not, by itself, give you the right to take a job. Parolees fall under federal regulation as a class that is not authorized to work by virtue of immigration status but that may request permission from USCIS.5eCFR. 8 CFR 274a.12 – Classes of Aliens Authorized to Accept Employment To work legally you file Form I-765 and receive an Employment Authorization Document.6U.S. Citizenship and Immigration Services. Once approved, the EAD lets you work for any employer, with one narrow exception: international entrepreneurs paroled under 8 CFR 212.19 receive work authorization tied to a specific start-up rather than an open-market EAD.6U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 10 Part A Chapter 2 – Eligibility Requirements USCIS has also extended employment authorization on refugee-like terms to certain groups as a matter of policy, including Afghan and Ukrainian parolees.
Watch the dates. If your parole is revoked or expires, any employment authorization based on that parole is automatically revoked with it.7U.S. Citizenship and Immigration Services. Leaving the United States Ends Your Parole
This is where parolees most often go wrong. Under 8 CFR ยง 212.5(e)(1), parole terminates automatically the moment you leave the United States.8eCFR. 8 CFR 212.5 – Parole of Aliens Into the United States No written notice is required. The departure itself ends it.
If you need to travel abroad, you can apply for an Advance Parole Document on Form I-131. But read the instructions carefully. Even with an Advance Parole Document in hand, your current parole still terminates when you depart. The Advance Parole Document only lets you present yourself at a port of entry and request parole again on the way back. That is a fresh discretionary decision by the officer at the port. There is no guarantee you will be paroled in again.9U.S. Citizenship and Immigration Services. How Parole Ends: Expiration, Re-Parole, and Revocation
Parole is always temporary. It runs for a limited period, often tied to a specific purpose such as finishing medical treatment or attending a court proceeding. The expiration appears on both your INAP and your I-94. Parole also ends earlier if you leave the country or acquire another immigration status.
If you stay past the expiration without departing or obtaining another status, the regulation says you “shall be processed” for further inspection or placed into removal proceedings.8eCFR. 8 CFR 212.5 – Parole of Aliens Into the United States Overstaying parole works much like overstaying a visa. You lose lawful status and become removable.
If you need more time, you can request re-parole by filing a new Form I-131 before your current parole expires. USCIS generally encourages filing no earlier than 180 days before expiration; requests filed too far in advance may be rejected without a refund of filing fees.10U.S. Citizenship and Immigration Services. You need to show that the original justification still applies or present a new qualifying basis.
USCIS can also actively revoke parole. It may do so when the purpose of the parole has been accomplished or when the agency concludes that neither humanitarian reasons nor significant public benefit warrants your continued presence.8eCFR. 8 CFR 212.5 – Parole of Aliens Into the United States Violating a condition of parole can also trigger termination or denial of re-parole.7U.S. Citizenship and Immigration Services. When USCIS decides to terminate on notice, it generally issues a written Notice of Intent to Terminate that identifies the grounds and gives you up to 30 days to submit a written rebuttal with supporting evidence. USCIS considers the response before making a final decision. If you don’t respond within the deadline, the parole is terminated.7U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 3 Part G Chapter 7 – Conditions on Parole and Termination Grounds that commonly trigger such a notice include providing false or inaccurate information in the original request, failing to comply with reporting requirements, violating conditions, or criminal activity. If you are served with a Notice to Appear in removal proceedings, that charging document itself acts as written notice of parole termination, unless USCIS specifies otherwise.8eCFR. 8 CFR 212.5 – Parole of Aliens Into the United States
After termination, you are restored to whatever status you had before parole was granted. In most cases, that means being treated as an applicant for admission and potentially placed into removal proceedings.
Conditions Printed on the Notice
Read the conditions on your INAP and follow them. They are not suggestions. Reporting requirements, address updates, restrictions on employment or activity, and any category-specific obligations are all binding, and breach of any of them can move you from valid parolee to a person facing a Notice of Intent to Terminate. If a condition is unclear, ask before you act, because the consequences of guessing wrong flow through everything else your INAP supports: your work permit, your ability to renew, your right to remain in the country at all.
