Is It Illegal to Not Change Your Address? Laws and Penalties

Not changing your address after a move isn’t illegal in a general sense, but several specific laws do require it, and some of them carry serious penalties. Most states give you 10 to 30 days to update your driver’s license. Federal law gives non-citizens just 10 days to report a move to immigration authorities. People on probation and anyone on a sex offender registry face the strictest rules of all. For everyone else, the bigger risk isn’t a direct legal violation — it’s the court notice, tax letter, or insurance document that goes to your old address and creates a much worse problem than the address itself.

When Not Updating Your Address Is Actually Illegal

Driver’s License and Vehicle Registration

Every state sets a deadline for updating the address on your license and registration after you move. These windows typically run from 10 to 30 days, with a handful of states allowing up to 60. The clock starts the day you move in.

Getting stopped with an outdated license address usually means a fix-it ticket or a small fine. The violation itself is minor. What makes it worse is what happens downstream: toll notices, parking citations, and automated enforcement letters all go to your registered address. Ignore enough of them because they never reached you, and you can end up with a suspended registration or a warrant for an unanswered ticket.

Fees for a replacement license run from free in some states to roughly $37 in others. Registration updates are similarly cheap.

Immigration: The 10-Day Federal Rule

The strictest address requirement in federal law applies to non-citizens. Under 8 U.S.C. § 1305, most non-citizens in the United States must report a new address within 10 days of moving.1Office of the Law Revision Counsel. 8 USC 1305 – Notices of Change of Address The only exceptions are certain diplomats on A or G visas and visitors admitted under the visa waiver program.2U.S. Citizenship and Immigration Services. The penalties are severe. Under 8 U.S.C. § 1306, failing to report is a misdemeanor punishable by a fine of up to $200, up to 30 days in jail, or both. More importantly, a person who fails to comply can be placed in removal proceedings regardless of whether they’re criminally convicted.3Office of the Law Revision Counsel. 8 USC 1306 – Penalties A violation can also damage future visa applications and immigration benefits.4U.S. Citizenship and Immigration Services. Probation, Supervised Release, and Sex Offender Registration

For anyone on federal probation or supervised release, address changes aren’t optional. Courts routinely impose a condition requiring at least 10 days’ advance notice to the probation officer before moving, or notification within 72 hours if the move was unexpected.6United States Courts. Chapter 2 – Notification of Change in Residence Moving without notifying is a supervision violation that can send you back before a judge for possible revocation.

Registered sex offenders face the heaviest penalties. Under the federal Sex Offender Registration and Notification Act, knowingly failing to update a registration, including an address change, is punishable by up to 10 years in federal prison when the offense involves interstate travel or a federal conviction.7Office of Justice Programs. Frequently Asked Questions – SMART State penalties vary but are universally treated as serious criminal offenses.

Professional Licenses and Concealed Carry Permits

If you hold a professional license — nursing, law, accounting, real estate — your licensing board almost certainly requires you to keep your address current. Deadlines of 15 to 30 days are common. The board rarely revokes a license just for a late address update, but renewal notices, continuing education reminders, and disciplinary letters all go to the address on file. Miss a renewal because the notice reached your old apartment, and your license can lapse. Practicing on a lapsed license is a separate violation.

Concealed carry permits work the same way. Most issuing states require you to notify the agency within a set number of days after a move. Carrying a permit with an incorrect address can cause the permit to be treated as invalid during a law enforcement encounter, even when you would otherwise be in full compliance.

When It’s Not Illegal, but Still a Serious Problem

For most people in most situations, the real danger of an outdated address isn’t a criminal penalty. It’s missing a piece of mail you absolutely had to answer.

Court Notices and Default Judgments

Courts don’t care why you didn’t show up. If a jury summons goes to your old address and you never appear, a federal judge can fine you up to $1,000, sentence you to up to three days in jail, order community service, or impose all three.8Office of the Law Revision Counsel. 28 USC 1866 – Selection and Summoning of Jury Panels State courts impose their own penalties, which follow a similar pattern of escalating fines and potential contempt findings.

Lawsuits are worse. If someone sues you and the summons is delivered to your last known address, the court in many situations considers you properly served. When you don’t respond because the paperwork never reached you, the plaintiff can ask for a default judgment. The court accepts the other side’s version of events as true and enters a binding ruling against you, potentially for the full amount claimed. Overturning a default judgment is sometimes possible by showing excusable circumstances, but it’s an expensive, uncertain process that requires hiring a lawyer after the fact.

IRS and Tax Correspondence

The IRS needs your current address to send refund checks, audit notices, and collection letters. If any of that goes to an old address and you miss a response deadline, the IRS proceeds without you. A missed audit notice can result in additional tax assessed entirely on the IRS’s own calculations.

You can update your address by filing Form 8822 by mail, including the new address on your next tax return, or calling the IRS. Form 8822 can’t be submitted electronically and takes four to six weeks to process.9Internal Revenue Service. Insurance

Auto insurers calculate your premium partly based on where your car is parked overnight, the garaging address. When you move and don’t update the policy, the insurer is pricing coverage for the wrong location. If you file a claim and the insurer discovers the car wasn’t kept where the policy says, the claim can be denied. In serious cases the insurer may cancel the policy retroactively or allege misrepresentation, which makes affordable coverage much harder to find afterward.

Homeowner’s and renter’s insurance follow the same logic. The policy covers a specific address. Move without updating it, and you may have no coverage at the new place while still paying for protection at a home you no longer occupy.

Voter Registration

Failing to update your voter registration won’t land you in jail, but it can effectively strip your ability to vote. Under the National Voter Registration Act, when election officials have reason to believe you’ve moved, they send a confirmation notice to the address on file. If you don’t respond and don’t vote in the next two federal general elections, your registration can be removed entirely.11U.S. Department of Justice. NVRA List Maintenance Guidance Until then, your status is marked “inactive,” which may require you to re-confirm your address at the polls before casting a ballot.

Social Security and Medicare

Communicate Changes to Personal Situation Missing this won’t cut off direct deposit payments, but paper correspondence about benefit adjustments, overpayment notices, or Medicare enrollment will go to the wrong place. An unanswered overpayment notice can eventually result in withheld benefits.

Medicare Part A and Part B follow you anywhere in the country, so a move alone won’t create a gap. Medicare Advantage and Part D plans operate within specific service areas, though, and moving outside your plan’s zone without enrolling in a new plan can cost you access to your network. A move triggers a Special Enrollment Period, but only if you act on it.

How to Update Everything Quickly

Most of these updates take minutes. Knocking them out in one sitting during your first week in the new place avoids nearly every problem above.

U.S. Postal Service

A USPS change of address doesn’t satisfy any legal requirement on its own, but it forwards your mail for up to a year, which buys time to update individual agencies.
