If your marriage license was not turned in to the clerk’s office after the ceremony, you are almost certainly still legally married, but the marriage is unrecorded and you cannot get a marriage certificate until the license is filed. In most states the ceremony itself creates the marriage, so the missing paperwork is an administrative gap rather than a legal void. The gap still matters: without a certificate on file, the proofs you need for insurance, name changes, immigration, and benefits are not available.
Are You Still Legally Married?
In the vast majority of states, a marriage becomes legally binding the moment the ceremony is properly performed under a valid license. Returning the signed license to the clerk records the event; it does not create the marriage. If your officiant performed the ceremony while the license was still valid, you are married in the eyes of the law. The marriage is simply missing from public records.
Federal tax rules follow the same logic. The IRS recognizes a marriage for federal tax purposes if it is recognized by the state where it was entered into.1Internal Revenue Service. Publication 501 – Dependents, Standard Deduction, and Filing Information The question is whether the marriage was validly performed, not whether it was recorded. What an unfiled license leaves you with is a gap between your legal status and the records agencies will check when they need proof.
What You Can’t Do Without a Recorded Marriage
The marriage certificate, not the license, is the document agencies accept as proof. A license grants permission to marry. A certificate shows the marriage took place.2USAGov. How to Get a Copy of a Marriage Certificate or a Marriage License If nothing was ever filed, there is no certificate to request, and the following everyday tasks stall.
Name Changes
The Social Security Administration requires original documents or copies certified by the issuing agency to change your name on a Social Security card. Photocopies and notarized copies are not accepted.3Social Security Administration. Passport rules are a little more forgiving. The State Department will accept a completed marriage license showing the marriage occurred, as long as it was issued by or filed with a state or local authority, in addition to a marriage certificate.4U.S. Department of State. 8 FAM 403.1 Name Usage and Name Changes A religious certificate alone is not enough. Driver’s license name changes vary by state but almost always require a certified government-issued proof.
Adding a Spouse to Health Insurance
Marriage opens a 60-day special enrollment window to add a spouse to a health plan.5HealthCare.gov. Getting Health Coverage Outside Open Enrollment Most employers want a certified marriage certificate as proof of the qualifying event. If the license was never filed, you may not be able to produce one before the window closes, and the next chance to enroll a spouse could be months away at open enrollment.
Immigration Petitions
This is where an unfiled license does the most serious damage. USCIS requires a registered marriage certificate as the primary evidence for a spousal green card petition and states explicitly that a license to marry is not sufficient evidence of a marital relationship.6U.S. Citizenship and Immigration Services. Policy Manual Volume 6, Part B, Chapter 6 – Spouses The certificate must show the full names of both parties, the date of the marriage, and evidence that it was timely registered with the appropriate civil authority.
If no certificate exists, USCIS will consider secondary evidence, which must include two or more sworn affidavits from people who are not parties to the petition and who have direct personal knowledge of the marriage.6U.S. Citizenship and Immigration Services. Policy Manual Volume 6, Part B, Chapter 6 – Spouses That route adds delay and attracts extra scrutiny. If an immigration case depends on your marriage, treat filing the license as urgent.
Military and Social Security Benefits
Active-duty service members need an original or certified marriage certificate to enroll a spouse in DEERS, which governs Tricare and other benefits.7TRICARE. Getting Married No certificate, no enrollment.
Social Security spousal benefit claims also require documentary evidence of the marriage. If the marriage was entered within two years of the application or there is any doubt about the relationship, SSA will not take just the statement on the application and will ask for documentation.8Social Security Administration. Tax Filing
Your marital status on December 31 sets your filing options for the whole year.9Internal Revenue Service. Essential Tax Tips for Marriage Status Changes A valid-but-unrecorded marriage still entitles you to file jointly, but if the IRS questions it, you would need to produce alternative evidence to back up the status.
Who Was Supposed to File It
In most states the officiant, not the couple, is legally responsible for returning the signed license. Return deadlines vary from as few as three days to 90 days after the ceremony. Some states classify a failure to file as a misdemeanor with fines of $100 or more per offense.
That rule does not resolve your paperwork, but it explains how most of these situations happen. Couples assume the officiant handled it. The officiant forgets, moves, or misplaces the license. By the time anyone notices, months or years have gone by. One phone call to the clerk’s office a few weeks after the ceremony to confirm the license arrived prevents nearly every problem described here.
How to Fix an Unfiled Marriage License
Start by calling the clerk’s office that issued the license. Have the ceremony date, location, and the officiant’s name and contact information ready. What happens next depends on what you still have and how much time has passed.
If You Still Have the Signed License
Late filing is often straightforward. Some clerks accept the license with a late fee. Others want a supporting affidavit from the officiant confirming the ceremony date. Late fees are usually modest, often in the range of $20 to $100, though they vary by jurisdiction.
If the Original License Is Lost
You will likely need a duplicate license, which both spouses and sometimes the officiant must sign. The duplicate is tied back to your original ceremony date. Replacement fees typically run $10 to $35, plus any late filing charge. Some offices also ask for an officiant affidavit or other proof the ceremony happened.
If Years Have Passed
Significant delay often requires more than a late filing. You may need to petition a court for delayed registration of marriage. The usual steps are to confirm with the state vital records office that no marriage is on file, file a petition with the court along with supporting evidence, and obtain a judge’s approval to register the marriage retroactively.
The evidence courts and agencies accept is broader than most people expect. SSA, for example, recognizes signed statements from the officiant, witness testimony, newspaper accounts of the wedding, and photographs from the ceremony as secondary proof.10Social Security Administration. GN 00305.025 Secondary Proof of Ceremonial Marriage Courts reviewing delayed registration petitions look at similar material. Pull together wedding photos, locate witnesses, and track down the officiant.
Court filing fees for delayed registration can run into the low hundreds of dollars, plus separate fees to the state vital records office for processing and certified copies. If the petition is approved without a hearing, the process can take a few weeks. A hearing adds more time.
Unfiled License Is Not the Same as an Expired License
These are different problems and the fixes are different. An unfiled license means a valid ceremony happened but was never recorded, and you are likely married. An expired license means no valid ceremony occurred under that license, either because the ceremony took place after the license expired or because no ceremony happened at all.
License validity periods range from 30 days to a full year depending on the state, with a handful of states imposing no expiration.2USAGov. How to Get a Copy of a Marriage Certificate or a Marriage License If your ceremony occurred after the license expired, the marriage may not be legally valid, and the fix is to obtain a new license and hold another ceremony, which can be a brief civil proceeding. If you are not sure whether the license was still valid on your ceremony date, check the expiration date on the license or call the issuing clerk, who can also tell you whether any marriage was ever recorded under it.
