Marriage Name Change: Social Security, Passport, and Taxes

A marriage name change starts with one document and one agency: take your certified marriage certificate to the Social Security Administration, get your record updated, and then use that updated record to change your name everywhere else. There’s no court order, no lawyer, and no federal fee. The work is in the sequence, because almost every other agency and institution will check what Social Security has on file before they’ll update their own records.

What a Marriage Certificate Actually Lets You Change

A marriage certificate generally supports taking your spouse’s last name, hyphenating both surnames, or moving your maiden name into the middle-name slot. The exact options vary by state. What it almost never covers is a first-name change or adopting a completely new surname unrelated to either spouse. Those require a separate court-ordered name change, with its own filing fees and paperwork.

Every agency downstream will compare the name on your marriage certificate to the name you’re requesting. If the certificate doesn’t support it, Social Security and your state’s motor vehicle office will reject the application. If you want something outside the standard options, deal with the court before starting anything below.

Step One: Social Security

Fill out Form SS-5, the Application for a Social Security Card, and submit it with your certified marriage certificate and proof of identity. Acceptable identity documents include a driver’s license, state ID card, or U.S. passport. The document must show your name along with either your date of birth, your age, or a photograph. A birth certificate alone won’t satisfy the identity requirement, though you may need one separately to establish citizenship if you don’t have a passport.

Every document must be an original or a copy certified by the issuing agency. Photocopies and notarized copies are not accepted.1eCFR. 20 CFR 422.107 – Evidence Requirements This catches people who arrive with a photocopy of their marriage certificate instead of the version with the raised seal.

You can apply by mail or in person at a local Social Security office. There is no fee.2Social Security Administration. Replace Social Security Card If you mail your application, include your original documents and the SSA will return them. The new card typically arrives within five to ten business days after processing.3Social Security Administration. Change Name with Social Security Mail-in applications can run two to four weeks when there’s a backlog.4Social Security Administration. How Long Will It Take to Get a Social Security Card?

Step Two: Driver’s License or State ID

Once Social Security has your new name, wait 24 to 48 hours for the federal database to sync before visiting your state’s motor vehicle office. The office verifies your new name against SSA records, and if the update hasn’t propagated, they’ll turn you away.

Bring your certified marriage certificate, your current license, and your new Social Security card (or at minimum the receipt showing you applied). The office will take a new photo and issue a temporary paper license while your permanent card is produced. Fees vary by state but typically run $10 to $50.

Many states impose a deadline for notifying the motor vehicle office after a name change, ranging from 10 to 60 days depending on where you live. Missing it doesn’t void your license, but some states charge a small fine. Don’t assume you have unlimited time.

Step Three: U.S. Passport

The passport process splits into two tracks depending on when you got married relative to when your passport was issued.

If your name changed within one year of your passport’s issue date, submit Form DS-5504 by mail with your current passport, the certified marriage certificate, and a new passport photo. There is no fee, though expedited processing costs $60.5U.S. Department of State. Name Change for U.S. Passport or Correct a Printing or Data Error

If your name changed more than one year after your passport was issued, use Form DS-82 to renew by mail. Same supporting documents, plus the standard adult passport book fee of $130.6U.S. Department of State. United States Passport Fees Your passport must have been issued when you were 16 or older, be within 15 years of its issue date, and be in reasonable condition. If not, you’ll need to apply in person with Form DS-11.

Until your new passport arrives, remember that your airline ticket name must match the photo ID you present at the airport. For domestic flights during the gap, use the updated driver’s license. For international travel, use the old passport and book the ticket to match, then sort it out when the new one arrives.

Tell Your Employer at the Right Time

The Social Security Administration instructs employers to keep using your old name on payroll records until you present your updated Social Security card. A W-2 filed under your new name before the SSA database reflects it can prevent your earnings from posting to your lifetime earnings record, which eventually affects your Social Security benefits.7Social Security Administration. Employer W-2 Filing Instructions and Information

Once you have the new card, bring it to HR or payroll along with your updated driver’s license. Your next W-2 will reflect your new name. For a mid-year change, the W-2 should show whichever name matches Social Security’s records on the date the form is prepared.

Taxes and the Name-Mismatch Rejection

The IRS validates every electronically filed return against Social Security records. If the name on your return doesn’t match what SSA has on file, the IRS rejects the e-file. You can correct and resubmit electronically, or file a paper return by the later of the original due date or 10 calendar days after the rejection notice.8Internal Revenue Service. Age, Name or SSN Rejects, Errors, Correction Procedures

The practical rule: file your return under whichever name Social Security has on record at the time you file. Got married in December but haven’t updated SSA by the time you file in February? Use your maiden name. Filing under the new name before the SSA database reflects it is the fastest way to trigger a rejection.

Banks, Credit Cards, and Credit Reports

Banks and credit card companies usually require a branch visit or a secure document upload through their app or website. Bring your marriage certificate, updated driver’s license, and new Social Security card. Start with the accounts you use most frequently.

You generally don’t need to contact Equifax, Experian, or TransUnion directly. When your creditors update their records and report your account information under your new name, the bureaus update your credit file automatically during their normal reporting cycle, typically within one to two billing cycles. Check your credit reports a month later to confirm everything synced.

Health Insurance and Other Policies

Marriage is a qualifying life event under federal health insurance rules, opening a special enrollment period, typically 60 days from the marriage date, to change your coverage outside normal open enrollment.9HealthCare.gov. Qualifying Life Event Even if you’re not switching plans, update your name with the insurer so your ID card and claims records stay consistent. A name mismatch between the insurance card and your doctor’s office records can delay claims.

Auto insurance, life insurance, homeowners or renters policies, and anything else tied to your legal name need the same update. These usually only require a phone call or a message through the insurer’s online portal.

TSA PreCheck and Global Entry

If you have TSA PreCheck, update your name through the enrollment provider you originally applied with. Until the name in TSA’s system matches your current ID, your PreCheck benefits won’t work at the airport.10Transportation Security Administration. My Personal Information Has Changed. How Do I Update My Information So That I Can Continue to Receive TSA PreCheck? The provider will tell you what to submit.

Global Entry members can request a name change through their Trusted Traveler Programs account online. Customs and Border Protection can sometimes process the update electronically. If not, visit a Global Entry enrollment center in person with your new passport, your Global Entry card, and your marriage certificate. The name update itself is free; a replacement card costs $25.

Voter Registration

Many states have same-day processes to handle mismatches at the polls, but it’s friction you’d rather not deal with on Election Day. Handle it when you update your driver’s license.

There’s No Deadline, but Waiting Makes It Harder

No federal law sets a deadline for changing your name after marriage. Your marriage certificate doesn’t expire, and you can use it five, ten, or twenty years later. The Social Security Administration does treat the timing differently based on how long you wait: if the name change happened within the last two years, your marriage certificate alone can serve as both the name-change document and a supporting identity document, which simplifies the mail-in process. After two years, SSA requires additional photo identification on top of the marriage certificate.12Social Security Administration. Application for Social Security Card – Form SS-5

State driver’s license deadlines do apply once you start the process. So take your time deciding, but once you file with Social Security, move through the rest of the list promptly. The smoothest approach is to finish Social Security, the driver’s license, and the passport in the same week, then work through the private accounts at whatever pace feels manageable.
