A name change after marriage in the United States does not require a court order. A certified marriage certificate is the legal proof agencies need, and you work through them in a specific order: Social Security first, then your driver’s license, then your passport, then banks, insurers, and everything else. There is no federal deadline, and the marriage certificate does not expire for this purpose, so you can start the day after the wedding or years later.
Decide Your New Legal Name First
Lock in the exact name before you file anything. Whatever you choose gets copied across every record you update, and small inconsistencies between agencies can take months to untangle. The standard options a marriage certificate supports are:
- Take your spouse’s surname and replace your current last name entirely.
- Hyphenate both surnames. Some older systems truncate long hyphenated names.
- Move your birth surname into the middle position and take your spouse’s surname as your last name.
- Keep your name unchanged. Marriage does not require a name change from either spouse, and no paperwork is needed to keep your birth name.
If what you want falls outside these options, such as inventing a new surname or changing your first name, you will need a court-ordered name change with a petition and a filing fee that varies by jurisdiction. That is a separate process from what follows.
Order Certified Copies of Your Marriage Certificate
Everything starts with a certified copy carrying an official seal and the registrar’s signature. The decorative certificate you may have signed at the ceremony is not the same thing, and agencies will not accept it.
Request certified copies from the vital records office in the state where the marriage was recorded.1USAGov. How to Get a Copy of a Marriage Certificate or a Marriage License Fees generally range from about $12 to $35 per copy, and most states let you order online, by mail, or in person. Order at least two or three. You will be submitting originals to multiple agencies, and having extras prevents a bottleneck where one office is holding your only copy while another needs it.
Update Your Social Security Card
Social Security comes first because nearly every other agency verifies against its records. The update is free.2USAGov. How to Get, Replace, or Correct a Social Security Card
Fill out Form SS-5, the Application for a Social Security Card.3Social Security Administration. Application for a Social Security Card Submit it with your certified marriage certificate as proof of the legal name change and an identity document such as a U.S. driver’s license or passport.4Social Security Administration. US Citizen – Adult Name Change on Social Security Card Some applicants can submit online; others will need an appointment at a local Social Security office. The new card arrives by mail in 5 to 10 business days.5Social Security Administration. Change Name with Social Security Your number does not change.
Make sure the name on the SS-5 matches the name on your marriage certificate exactly. A spelling or abbreviation that is not on the certificate will get the application kicked back.
Update Your Driver’s License
Wait 24 to 48 hours after Social Security processes your change before going to the state motor vehicle agency. That window lets the federal database sync with state systems. Show up too early and the electronic verification may still pull your old name and reject the update.
Bring your new Social Security card (or an SSA verification letter), your certified marriage certificate, and your current driver’s license. Replacement fees vary by state.
REAL ID matters at this visit. Since May 2025, a REAL ID-compliant license or identification card has been required for domestic air travel and access to certain federal facilities.6Transportation Security Administration. REAL ID If you are getting a REAL ID now or already have one, you need documentation for every legal name change in your history. Your marriage certificate bridges birth name to married name. If you have had earlier name changes, bring a document for each one. Gather those before the appointment so you are not sent home.
Update Your U.S. Passport
If you hold a U.S. passport, update it before any international travel. The State Department uses different forms and fees depending on how recently the passport was issued.7U.S. Department of State. Change or Correct a Passport
- Passport issued less than one year ago: submit Form DS-5504 by mail with your current passport, a certified marriage certificate, and a new passport photo. No fee for the change itself; expedited processing is $60.
- Passport issued more than one year ago: renew using Form DS-82 by mail if eligible, or Form DS-11 in person, with a certified marriage certificate. The renewal fee for a passport book is $130.8U.S. Department of State. Passport Fees
The one-year free correction window is easy to miss, so act on it if your passport is recent. If a honeymoon abroad is coming up before the update clears, book the ticket in the name on your current passport. A ticket in your new married name against a passport in your birth name creates problems at the airport.
Taxes and Your Employer
There is no separate IRS form for a name change. The IRS pulls your name from Social Security records when it processes your return, and the name on the return must match what SSA has on file, or processing and any refund may be delayed.9Internal Revenue Service. Name Changes and Social Security Number Matching Issues
If you married late in the year and have not updated SSA by filing time, use your former name on the return. You can still file married filing jointly even if one spouse has not yet changed their name with SSA.9Internal Revenue Service. Tell your employer so your W-4 and payroll records match.10Internal Revenue Service. Form W-4 Employees Withholding Certificate Your year-end W-2 needs to match your Social Security card. If it arrives with the wrong name, ask for a corrected version before you file.
Voter Registration
Update your voter registration through vote.gov by selecting your state and following the instructions to change your information online, by mail, or in person.11USAGov. How to Update or Change Your Voter Registration Most states accept changes year-round, but updates are typically frozen for a period before an election. Showing up to vote with ID that does not match the rolls can mean delays or a provisional ballot, so handle this well in advance.
Banks, Insurance, and Everything Else
Once your government documents are updated, you have what you need for private institutions. Banks generally want an in-person branch visit with your new driver’s license and a certified marriage certificate. They will update account names, reissue debit and credit cards, and order new checks. Multiple banks or credit unions can take a full day.
Insurers covering health, auto, and life policies all need the update. A claim filed under a name that does not match the policy can trigger delays or coverage questions at the worst possible time. Most insurers handle updates by phone or online portal with a copy of your marriage certificate.
Also update utility accounts, subscription services, frequent flyer programs, and any professional licenses you hold. Utilities and streaming services usually accept a digital copy of your updated ID. Licensing boards tend to have their own form and may charge a small reissue fee. Keep a list as you go, because an old account is easy to forget until it surfaces months later with the wrong name on a statement.
