Things You Actually Can’t Do Until You’re 25: Congress, Cars, Hotels

A handful of real restrictions in the United States stay in place until your 25th birthday: serving in the U.S. House of Representatives, renting a car without an underage surcharge, qualifying for the standard adult rate on car insurance, booking certain hotels and short-term rentals, and adopting a child in a small number of states. These are the things you can’t do until you’re 25, and each one has its own reason for drawing the line there.

Serve in the U.S. House of Representatives

The Constitution sets 25 as the minimum age to serve in the House. Article I requires a Representative to have reached that age, held U.S. citizenship for seven years, and reside in the state they represent.1Congress.gov. U.S. Constitution Article I Section 2 Clause 2 Voter support doesn’t override this. A 24-year-old could win in a landslide and the House could still refuse to seat them until the birthday arrives.

The House judges its own members’ qualifications, so enforcement hasn’t been perfectly uniform across history.2U.S. House of Representatives. Constitutional Qualifications Today, though, the age floor is treated as firm.

Rent a Car Without the Underage Surcharge

Most rental companies will rent to you at 21, but they charge a daily surcharge until you turn 25. At Enterprise, the average young renter fee runs about $25 per day.3Enterprise Rent-A-Car. What Are Your Age Requirements for Renting Budget charges roughly $27 per day at most locations.4Budget. How Old Do You Have to Be to Rent a Car Across the industry the fee generally sits between about $10 and $65 per day depending on the company, the location, and the vehicle. On a week-long rental, that adds $175 to $450 on top of the base rate.

Certain vehicle categories are off the table entirely for drivers under 25. Enterprise limits renters aged 21 to 24 to economy, compact, intermediate, standard, and full-size cars, plus cargo vans, minivans, pickups, and SUVs seating up to five passengers.3Enterprise Rent-A-Car. What Are Your Age Requirements for Renting Luxury sedans, high-performance vehicles, large passenger vans, and premium SUVs are reserved for the 25-and-over crowd. A clean driving record and your own insurance don’t change this. The restrictions come from fleet insurance underwriting, not your personal risk profile.

A few programs can waive or reduce the surcharge before 25. U.S. government employees traveling on official orders with authorized travel documents typically pay no underage driver fee and can rent as young as 18.5National Car Rental. Government Programs AAA members aged 20 to 24 can get the fee waived at Hertz locations, and USAA members often see waivers through partner companies starting at 21. Some corporate and university accounts include fee waivers too. If you rent often, it’s worth checking whether a membership or employer program covers the surcharge.

Pay a Lower Car Insurance Rate

Your 25th birthday doesn’t flip a switch on your bill, but it does trigger a noticeable drop. At Progressive, rates fall about 8% on average at 25.6Progressive. What Age Does Car Insurance Get Cheaper Across the industry the decrease typically ranges from about 7% to 18%, with companies like Allstate on the higher end and USAA on the lower end. Driving record, location, vehicle, and coverage all factor in, but age is weighted heavily.

The logic is actuarial. Younger drivers file more claims, and accident frequency drops meaningfully around 25. A couple of states prohibit insurers from using age as a rating factor at all, so the birthday discount doesn’t apply everywhere. For most drivers, though, 25 is the first time age starts working in their favor on premiums rather than against them.

Book Certain Hotels and Short-Term Rentals

Most hotels set their minimum check-in age at 18 or 21, but some individual properties push it to 25.7Hotwire. What Is the Minimum Age Requirement for Check-In This isn’t a chain-wide standard at major brands; it varies property by property, often based on location and clientele. A resort in a spring-break destination is more likely to enforce 25 than a business hotel near an airport. These requirements are matters of private contract, and a property can cancel your reservation at check-in if you don’t meet the age threshold. Checking the specific hotel’s policy before booking is the only way to avoid showing up with luggage and no room.

Short-term rental platforms add another layer. On Airbnb, hosts can set a minimum booking age of up to 25, and the restriction applies to the person making the reservation, not to other guests in the group. Hosts who set an age minimum must communicate it clearly before booking and allow a penalty-free cancellation if you don’t qualify.8Airbnb. Age Minimums for Homes in the United States Vrbo similarly lets hosts include age requirements in their house rules. If you’re under 25 searching for an entire home in a popular area, a meaningful share of listings may be unavailable. The common workaround is having a friend who’s 25 or older make the booking, but that person becomes legally responsible for the reservation.

Adopt a Child in Some States

Most states allow adults 18 and older to petition for adoption, but a small number set the minimum at 25. Several states also require the adoptive parent to be at least 10 to 15 years older than the child, which can function as a de facto age barrier for younger adults even where the statutory minimum is lower.

Private agencies sometimes layer on their own requirements beyond state law. An agency may prefer applicants who are 25 or older based on internal policies around financial stability and life experience, even in states where 18-year-olds are legally eligible. The state minimum is only the first hurdle. Agency criteria and the home study process add screening that tends to favor older applicants.

Why 25

The thread connecting most of these restrictions is brain development. Research published by the National Institutes of Health confirms that the prefrontal cortex, which handles decision-making, impulse control, and risk assessment, is one of the last parts of the brain to fully mature, and that process isn’t complete until approximately age 25. The brain undergoes a sustained rewiring process from puberty through the mid-20s, with the prefrontal cortex reaching full development around 25.9National Institutes of Health. Insurance companies, rental agencies, and hotels didn’t pick 25 arbitrarily. Their actuarial data on accidents, property damage claims, and risky behavior aligns with what neuroscience now explains. The age-25 requirement in Article I predates any of that research, but it reflects a similar intuition about readiness for serious responsibility. As long as the data keeps pointing to 25 as the inflection point, these restrictions are unlikely to move.
