Types of Law Specialties: Practice Areas and How Lawyers Charge

The main types of lawyers in the United States are organized around the kind of legal problem they handle: criminal defense, family matters, estates, personal injury and other civil disputes, business and corporate work, tax, intellectual property, real estate, employment, civil rights, immigration, environmental regulation, and health care. Within each of those broad fields, attorneys often narrow further still. Picking the right one matters because a specialist who works in an area daily will spot issues a generalist misses, and legal problems rarely sit neatly inside a single category.

Criminal Lawyers

Criminal law splits cleanly down the middle of the courtroom. Prosecutors represent the government and carry the burden of proving guilt beyond a reasonable doubt. Defense attorneys represent the accused, and the Sixth Amendment guarantees anyone facing criminal prosecution the right to counsel; public defenders fill that role for people who cannot afford to hire a private lawyer.1Constitution Annotated. Amdt6.6.3.1 Overview of When the Right to Counsel Applies

Within criminal practice, attorneys usually narrow their focus. White-collar specialists handle fraud, embezzlement, and insider trading. Federal wire fraud alone carries a maximum sentence of 20 years in prison, rising to 30 years and a $1,000,000 fine when the scheme targets a financial institution or involves disaster-relief funds.2Office of the Law Revision Counsel. 18 USC 1343 – Fraud by Wire, Radio, or Television Other criminal lawyers concentrate on drug offenses, violent felonies, DUI defense, or juvenile cases. Most of their time goes to negotiating plea agreements and understanding sentencing guidelines, since the vast majority of criminal cases resolve without a trial.

Family Lawyers

Family lawyers handle the legal side of personal relationships. Divorce is the core of the practice: dividing marital property, working out spousal support, and setting parenting plans for children. Prenuptial agreements fall here too, defining each spouse’s property rights before a marriage begins so disputes later have a written answer.

Adoption is a subspecialty that involves terminating one set of parental rights and establishing another. International adoptions add complexity because they combine U.S. immigration requirements with the laws of the child’s country of origin. Family lawyers also obtain protective orders in domestic violence situations, handle paternity disputes, and modify existing custody or support orders when circumstances change.

Estate Planning and Probate Lawyers

Estate planning lawyers help people decide what happens to their money and property after death, and during periods of incapacity. The core tools are wills and trusts. A will names beneficiaries and an executor. A revocable trust can transfer assets outside of probate, saving time and keeping details private. These attorneys also draft powers of attorney and health care directives so a trusted person can make financial or medical decisions when the client cannot.

When someone dies, probate attorneys guide the executor through validating the will, inventorying assets, paying debts, and distributing what remains. Fees and timelines vary widely by jurisdiction, and executor mistakes can create personal liability. For larger estates, tax planning becomes central, and estate attorneys work with accountants to minimize federal estate and gift tax exposure.

Personal Injury and Civil Litigation Lawyers

Civil litigation is the broad category covering lawsuits between private parties seeking money damages rather than criminal penalties. A civil litigator might handle a contract dispute, a business partnership that fell apart, or a construction defect claim. The work means drafting complaints, running discovery, arguing motions, and sometimes trying the case to a jury.

Personal injury is the most visible subspecialty. These lawyers represent people hurt by someone else’s negligence, whether in a car crash, a slip-and-fall, or a medical procedure gone wrong. Product liability is a related niche focused on injuries caused by defective or dangerous products, usually against a manufacturer or distributor. Most personal injury attorneys work on contingency: they collect nothing unless the client wins. The standard fee runs about one-third of the recovery if the case settles, climbing to roughly 40 percent if it goes to trial.

Timing is unforgiving in civil cases. Every type of claim has a statute of limitations, and missing it ends the right to sue. State deadlines for private lawsuits vary by claim type and jurisdiction, with many running between two and six years.

Business, Corporate, and Bankruptcy Lawyers

Corporate attorneys keep businesses legally functional from formation through dissolution. Transactional lawyers are the deal-makers who structure mergers and acquisitions, run due diligence to uncover hidden liabilities, and draft the agreements that transfer ownership. The work happens almost entirely outside the courtroom, and a good transactional lawyer catches problems before they become disputes.

Corporate litigators step in when deals collapse or company officers breach their duties. When a director or officer violates a duty of loyalty or care, the company or its shareholders can sue for damages, demand the return of misappropriated assets, or ask a court to void tainted contracts. Securities lawyers handle a different slice of corporate practice, making sure companies issuing stock or bonds meet federal disclosure and registration rules.

Bankruptcy specialists guide businesses through financial distress. Chapter 11 reorganization lets a company keep operating while restructuring its debts under a court-approved plan, usually with the existing management staying in possession of the assets.3United States Courts. Tax Lawyers

Tax attorneys interpret the Internal Revenue Code to help individuals and businesses structure transactions in ways that legally minimize tax.5Internal Revenue Service. Tax Code, Regulations and Official Guidance This goes well beyond filing returns. They advise on the tax consequences of selling a business, restructuring debt, setting up charitable foundations, and moving assets across borders. When disputes arise, they represent clients in audits, administrative appeals before the IRS, and litigation in U.S. Tax Court.

Tax touches nearly every other specialty. Estate planners need it for gift and estate strategy. Corporate lawyers need it to structure mergers without triggering unnecessary tax. Real estate attorneys need it to navigate 1031 exchanges. That cross-cutting nature makes tax one of the more intellectually demanding specialties, and one where mistakes carry immediate dollar-for-dollar consequences.

Intellectual Property Lawyers

Intellectual property attorneys protect creations of the mind: inventions, brand identities, creative works, and confidential business information. The field breaks into several subspecialties, each governed by its own federal statute.

Patent lawyers help inventors secure exclusive rights to their inventions. A standard utility patent lasts 20 years from the filing date.6Office of the Law Revision Counsel. 35 USC 154 – Contents and Term of Patent Patent practice is unusual in that it requires a scientific or engineering background; the U.S. Patent and Trademark Office only lets attorneys with a qualifying technical degree sit for the patent bar.7U.S. Patent and Trademark Office. General Requirements Bulletin for Admission to the Examination

Trademark attorneys protect brand identity: logos, names, slogans, and other marks that distinguish one company’s goods from another’s. Registration is just the start. Owners must file a declaration of continued use between the fifth and sixth year after registration, and then renew every ten years; missing those deadlines can cancel the registration.8U.S. Patent and Trademark Office. Post-Registration Timeline Copyright lawyers handle ownership and licensing of creative works like books, music, software, and films. Trade secret attorneys protect confidential business information through nondisclosure agreements and litigation when secrets are stolen.

Real Estate Lawyers

Real estate attorneys handle the legal mechanics of buying, selling, leasing, and developing property. In a residential purchase, the lawyer reviews title to confirm the seller actually owns the property free of unexpected liens, drafts or reviews the purchase agreement, and makes sure the closing documents are properly executed. Title insurance against hidden defects in ownership records is a routine part of the process.

Commercial real estate adds complexity. Transactions can involve environmental assessments, zoning approvals, multi-party financing, and lease negotiations for buildings with dozens of tenants. Zoning specialists help developers get permits for changing how a parcel can be used, which often means working through local planning boards and public hearings. Landlord-tenant disputes are their own subspecialty, covering lease violations, evictions, and security deposit fights.

Employment Lawyers

Employment attorneys work both sides of the workplace. Some represent employees in claims for unpaid wages, wrongful termination, or harassment. Others represent employers, drafting compliant policies, answering administrative complaints, and defending lawsuits. The Fair Labor Standards Act is foundational here, requiring covered employers to pay overtime at one and a half times the regular rate for hours worked beyond 40 in a workweek.9U.S. Department of Labor. Overtime Pay

Workplace discrimination makes up a large share of employment work. An employee claiming discrimination based on race, sex, religion, national origin, age, or disability generally must file a charge with the Equal Employment Opportunity Commission before suing. The deadline is 180 days from the discriminatory act, extended to 300 days in states with their own anti-discrimination enforcement agency.10U.S. Equal Employment Opportunity Commission. Time Limits For Filing A Charge Federal employees follow a different track with a 45-day window to contact an agency EEO counselor. Missing these deadlines forfeits the claim, which is where a specialist earns the fee: they know the procedural traps that swallow cases before the merits are ever heard.

Civil Rights Lawyers

Civil rights attorneys represent people whose constitutional or statutory rights have been violated, often by government actors. The Fourteenth Amendment’s guarantee that no state shall deny any person equal protection of the laws is the backbone of much of this work.11Congress.gov. Constitution of the United States – Fourteenth Amendment Cases include police misconduct and excessive force, unconstitutional prison conditions, voting rights restrictions, and First Amendment challenges involving speech or religious liberty.

Much of this litigation runs through Section 1983, the federal statute that lets individuals sue state and local officials for constitutional violations. Remedies can include money damages, injunctions ordering the government to change its practices, or both. Class actions are common when the challenged policy affects a large group. Many civil rights attorneys work at nonprofit legal organizations, though private firms take these cases too.

Immigration Lawyers

Immigration attorneys help foreign nationals obtain legal status, keep it, and defend against deportation. The practice spans family-based petitions in which a U.S. citizen or permanent resident sponsors a relative, employment-based visas across five federal preference categories, and humanitarian protections like asylum and refugee status.12U.S. Department of State. Employment-Based Immigrant Visas

Deportation defense is the high-stakes end. Removal proceedings are adversarial: a government attorney argues for deportation while the respondent’s lawyer argues for relief. There is no constitutional right to a government-appointed attorney in immigration proceedings, so many people face removal without any lawyer at all. Specialists review criminal history, immigration violations, and family ties to identify possible defenses, which might include cancellation of removal, adjustment of status, or asylum.

Naturalization is the process by which a lawful permanent resident becomes a U.S. citizen. The basic requirements are five years of continuous residence (three if married to a U.S. citizen), physical presence for at least half of that period, good moral character, and the ability to pass English and civics exams.13Office of the Law Revision Counsel. 8 USC 1427 – Requirements of Naturalization Immigration lawyers walk applicants through the paperwork, biometrics appointments, and USCIS interviews.

Environmental Lawyers

Environmental attorneys sit at the intersection of business activity and ecological regulation. The practice is built on federal statutes enforced primarily by the Environmental Protection Agency. The Clean Air Act governs air quality standards and emissions, with criminal penalties reaching up to 15 years for knowing endangerment.14U.S. Environmental Protection Agency. Criminal Provisions of the Clean Air Act The Clean Water Act regulates discharges into waterways. The National Environmental Policy Act requires federal agencies to prepare environmental impact statements before approving major projects that could significantly affect the environment.15U.S. Environmental Protection Agency. National Environmental Policy Act Review Process

CERCLA, better known as the Superfund law, is where environmental practice gets expensive. It holds current and former property owners, operators, and waste generators liable for cleanup of hazardous contamination, even when the contamination happened decades ago under different ownership.16U.S. Environmental Protection Agency. Superfund CERCLA Overview Environmental lawyers defend companies facing EPA enforcement actions, advise on permitting and regulatory compliance for new projects, and run environmental due diligence during real estate and corporate deals so the buyer doesn’t inherit the cleanup bill.

Health Care and Elder Law Lawyers

Health care attorneys work inside the dense regulatory framework that governs hospitals, physician practices, insurers, pharmaceutical companies, and medical device makers. HIPAA compliance is a major area, covering patient privacy policies, data breach response, and the security standards for electronic medical records. These lawyers build compliance programs, train staff, and defend organizations when regulators investigate.

Medicare and Medicaid fraud defense is another significant piece. The federal government pursues health care fraud aggressively through the False Claims Act, where penalties can include treble damages plus per-claim fines. Health care transactional lawyers handle mergers between hospital systems, physician group acquisitions, and joint ventures, all of which must navigate anti-kickback statutes and self-referral prohibitions with no real equivalent in other industries. Elder law overlaps here, with attorneys helping aging clients plan for long-term care costs, qualify for Medicaid, set up guardianships or conservatorships, and protect against financial exploitation.

How Lawyers Charge, and How to Pick One

Fee structures vary by specialty in predictable ways. Personal injury and some employment discrimination lawyers work on contingency, collecting a percentage only if the client wins. Criminal defense, corporate, tax, and real estate attorneys almost always charge by the hour or a flat fee for defined tasks like drafting a will or closing a home purchase. Hourly rates for specialized attorneys generally run from around $150 to $500 or more, depending on the attorney’s experience, the complexity of the work, and the local market.

When hiring a specialist, the question that matters most is whether the attorney regularly handles your specific type of problem. A corporate lawyer who occasionally drafts a will is not an estate planner. A general litigator who takes a patent case every few years is not a patent attorney. The point of legal specialization is depth, and depth comes from repetition.
