A legacy contact is a person you designate through a tech platform’s own settings to manage or download your account data after you die. Apple, Meta, and Google each offer a version of this tool, and the person you pick can get to your photos, posts, and files without a court order or a probate attorney. The designation also carries real legal weight: under the digital assets law most states have adopted, a legacy contact you name inside the platform overrides conflicting instructions in your will.
What a Legacy Contact Can Actually Do
The powers depend on the platform, and the pattern is consistent across all three: your contact can preserve and download your content, but they cannot operate the account as if they were you.
On Apple, a legacy contact can access and download most of what sits in your iCloud account, including photos, notes, mail, contacts, calendars, and files in iCloud Drive. They cannot reach your iCloud Keychain (saved passwords and payment cards), your licensed media purchases, or anything not synced to iCloud. Apple also sets a hard clock: the contact has three years from the date their access request is approved to pull everything down, after which the account is permanently deleted.1Apple Support. On Facebook, a legacy contact can write a pinned post on your memorialized profile (useful for sharing funeral details), respond to new friend requests, update your profile and cover photos, and decide who can see or add tributes. If you turn the option on in advance, they can also download a copy of your posts, photos, and profile information. They cannot log into your account, read your private messages, or remove your existing friends.2Meta. Adding a Legacy Contact
Google takes a different approach through its Inactive Account Manager. Instead of waiting for a death certificate, Google triggers your plan after the account sits idle for a period you choose. Your trusted contacts then get an email with links to download whichever data categories you selected during setup, such as Gmail, Drive, YouTube, or Blogger content.3Google Account Help. Why the Platform Setting Beats Your Will
Most people assume their will controls what happens to everything they own, including their accounts. For digital assets, that is not how the priority runs. Under the Revised Uniform Fiduciary Access to Digital Assets Act (RUFADAA), adopted in nearly every state, the legacy contact you designate inside a platform’s own tool takes priority over anything in your will, trust, or power of attorney. If your will names your spouse as executor over all digital assets but your Apple legacy contact is your best friend, your best friend gets the Apple account.
The priority runs in three tiers. First is the platform’s own tool, like a legacy contact designation. Second is instructions in a will, trust, or power of attorney. Third is the platform’s default terms of service. That order is why setting up a legacy contact is the single most powerful lever you have over your digital life after death. It also means your platform designations and your estate plan need to agree, because if they conflict, the platform wins.
Who You Can Name
Your legacy contact does not have to be a legal heir or anyone named in your will. You pick based on trust and follow-through, not bloodline.
Age requirements vary. Apple sets the minimum at 13 to designate or serve as a legacy contact, though the exact age varies by country.1Apple Support. You are not limited to a single person. On Apple, you can designate more than one legacy contact, and any one of them can independently request access.1Apple Support. The person does not need special technical skill. The real bottleneck is practical: on Apple, your contact needs the access key you generated during setup to prove their authority after you die. If the key is lost, there is no recovery process, so a printed copy stored with your other estate documents is worth more than any technical sophistication on their part.1Apple Support. What Happens If You Never Set One Up
Skip this step and your family faces a much harder path. Without a legacy contact, Apple historically required a court order before anyone could access the account data, which means hiring a probate attorney and waiting months. Facebook will still let family members request memorialization of an account without a legacy contact, but no one gets the management tools, and no changes can be made to the memorialized profile.4Facebook Help Center. Under RUFADAA, when there is no in-platform designation and no instructions in a will or trust, the platform’s default terms of service control. For most services, the default is that nobody gets in. That is where families end up paying for legal help to petition a court for access, an expense and delay that a short setup would have avoided.
Keeping Your Designation Current
You can change or remove a legacy contact at any time through the same account settings where you added them. After you remove someone, any access key they received becomes invalid, so old printouts stop working on their own.5Apple Support. Remove a Legacy Contact From Your Apple Account
This matters more than people expect. Relationships shift. Because platform designations outrank your will under RUFADAA, an outdated legacy contact on Apple or Facebook creates a problem your estate attorney cannot fix after the fact. Treat these settings the way you treat beneficiary designations on a life insurance policy or retirement account, and review them on the same schedule.
