A statutory notice is a formal written communication that a government agency or court is required by law to send you before taking certain actions against you, your money, or your property. It matters because the notice itself starts a clock: you get a defined window to respond, and if you let that window close, the agency can proceed with whatever it proposed and you usually lose the right to fight it. Response periods run anywhere from 15 working days to 90 days depending on which agency sent it and what action is involved.
Why This Kind of Notice Carries Legal Weight
Plenty of government mail is informational. A statutory notice is not. It exists because a specific law requires the agency to tell you what it plans to do and give you a window to respond before it does it. That requirement traces to the Due Process Clause of the Constitution, which demands notice and an opportunity to be heard before the government deprives anyone of life, liberty, or property.1Congress.gov. Fourteenth Amendment – Overview of Procedural Due Process in Civil Cases
The practical consequence is enforceability. Once the response period runs out, the agency can assess a tax, levy an account, impose a fine, revoke a benefit, or whatever else the notice described. In many situations, failing to respond in time waives your right to contest the action at all.
Because the law mandates these notices, the issuing agency usually must follow specific rules about delivery, content, and timing. Those rules vary by statute, but a legitimate notice will identify the issuing authority, the legal basis for the action, the specific action proposed, and the deadline for your response.
The Types You Are Most Likely to Receive
Statutory notices appear across nearly every area of government. A handful account for most of what ordinary people and small businesses actually see.
IRS Notices
The IRS issues more statutory notices than any other federal agency most people deal with. The most consequential is the statutory notice of deficiency, often called the “90-day letter.” It tells you the IRS has determined you owe additional tax and gives you 90 days from the mailing date to petition the U.S. Tax Court. If you live outside the United States, you get 150 days. Miss that window and the IRS assesses the full deficiency, with no further opportunity to dispute it in Tax Court.2Office of the Law Revision Counsel. 26 USC 6213 – Restrictions Applicable to Deficiencies; Petition to Tax Court
Shorter deadlines apply to other IRS letters. A CP2000 notice, which flags a mismatch between what you reported and what third parties reported about you, gives you 30 days to respond.3Internal Revenue Service. OSHA Citations
When OSHA inspects a workplace and finds violations, it issues citations with proposed penalties. The employer has 15 working days from receipt to notify the area director in writing of any intent to contest the citation or the penalty.6Occupational Safety and Health Administration. 1903.17 – Employer and Employee Contests Before the Review Commission Penalties for a single serious violation can reach $16,550, and willful violations can run up to $165,514 per violation.7Occupational Safety and Health Administration. 1903.15 – Proposed Penalties If the 15 working days pass with no written contest, the citation becomes a final, unappealable order.
EPA Administrative Complaints
The EPA issues administrative orders when a facility violates environmental regulations, ranging from negotiated consent orders to unilateral orders that demand compliance without the facility’s agreement.8United States Environmental Protection Agency. Types of and Approaches to RCRA Corrective Action Enforcement Actions A facility that receives an administrative complaint has 30 days to file a written answer that specifically admits, denies, or explains each factual allegation.9eCFR. 40 CFR Part 22 – Consolidated Rules of Practice
Social Security Overpayment Notices
If the Social Security Administration determines it paid you more than you were owed, it sends an overpayment notice. The SSA waits at least 30 days after mailing before it begins collecting. Request a waiver or file an appeal within that 30 days and the SSA pauses collection until it decides your case. A waiver is available if you believe the overpayment was not your fault and you cannot afford to repay it.10Social Security Administration. Resolve an Overpayment
Eviction Notices
Landlord-tenant law is governed by individual states, so eviction notice requirements vary. Most states require a written notice before a landlord can file an eviction lawsuit, with timeframes typically running from 3 days for serious lease violations or unpaid rent up to 30 or 60 days for month-to-month tenancies. A landlord cannot skip the notice and remove you directly. Removal requires a court order, and self-help evictions are prohibited.
How to Tell a Real Notice From a Scam
Fake notices designed to frighten people into paying immediately are a staple of government-impersonation scams. Before you act on anything, confirm the notice is real.
Red Flags
- Demands for payment by gift cards, prepaid debit cards, wire transfers, cryptocurrency, or mailed cash. These are never legitimate payment methods for any federal agency.11Internal Revenue Service. Ways to Tell if the IRS Is Reaching Out or if Its a Scammer
- Threats of immediate arrest. No federal agency threatens arrest for failing to pay money on the spot.12Social Security Administration. Protect Yourself From Social Security Scams
- First contact by email, text, or social media. The IRS does not make initial contact that way, and the SSA will never direct-message you on social media.12Social Security Administration. Protect Yourself From Social Security Scams
- Pressure to act within hours. Real statutory notices give you days or weeks.
- Requests to “verify” personal information you never provided. Real notices reference information the agency already has.
How to Confirm
For an IRS letter, log into your IRS Online Account to see whether the notice appears in your file, or call IRS customer service using the number listed on irs.gov rather than any number on the suspicious letter.11Internal Revenue Service. Ways to Tell if the IRS Is Reaching Out or if Its a Scammer For an SSA letter, call 1-800-772-1213 or visit your local office. For any other agency, look up its official contact information independently and call to confirm.
What to Do After You Confirm It Is Real
Once you know the notice is legitimate, work through the following in order. The costliest mistake is setting it aside and forgetting about it until the deadline is gone.
Find the Deadline First
Locate the response date before anything else. Put it on your calendar and set a phone reminder. Then count backward so you have time to gather documents and, if needed, consult a professional. A 90-day Tax Court window sounds generous until you have to assemble records, hire a tax attorney, and prepare a petition. A 30-day OSHA or SSA window moves faster still.
Read the Whole Notice
Statutory notices follow a predictable structure. Identify the issuing agency, the statute or code section cited, the action proposed, the facts the agency is relying on, and your options for responding. IRS notices commonly include a computation showing how the deficiency was calculated and a waiver form you can sign if you agree with the amount.13Internal Revenue Service. 4.8.9 Statutory Notices of Deficiency Knowing exactly what the agency is claiming saves time when you respond.
Gather Supporting Documents
Pull every record that bears on the notice. For a tax notice, that means returns, W-2s, 1099s, receipts, and bank statements. For an OSHA citation, inspection reports, safety training logs, and maintenance records. For an SSA overpayment, benefit statements and documentation of your income or living situation during the period in question. The quality of your response depends almost entirely on the evidence behind it.
Decide Whether You Need Help
Not every notice requires a professional. Some do. For a large IRS deficiency, a tax attorney or enrolled agent can petition the Tax Court on your behalf, and filing IRS Form 2848 authorizes a representative to receive your confidential tax information and respond to notices for you.14Internal Revenue Service. About Form 2848, Power of Attorney and Declaration of Representative For OSHA citations with penalties over $100,000, an attorney who practices before the Occupational Safety and Health Review Commission is worth the cost. For smaller matters where you agree with the facts and just need to arrange payment, the instructions on the notice are usually enough.
Respond in Writing and Keep Copies
Always respond in writing, even if you also call. Written responses create proof you met the deadline. Send by certified mail with return receipt requested, and keep copies of everything, including the mailing receipt and the returned green card. These records matter if the agency later claims it never received anything.
How to Challenge or Dispute the Action
Getting a notice does not mean the agency is right. The law builds in ways to push back.
Administrative Appeals
Most agencies offer an internal appeal before anything goes to court. When a federal agency initiates a formal adjudication, it must inform you of the time, place, and nature of any hearing, the legal authority for it, and the facts and legal issues at stake, and it must give you the opportunity to submit facts, arguments, and settlement proposals.15Office of the Law Revision Counsel. 5 USC 554 – Adjudications
For IRS notices, the Collection Due Process hearing is a key mechanism: if you receive a notice of intent to levy or a notice of federal tax lien filing, you have 30 days to request a hearing with the IRS Office of Appeals.5Taxpayer Advocate Service. Notices From the IRS For EPA administrative complaints, you have 30 days to file a written answer and can request a hearing in that answer.9eCFR. 40 CFR Part 22 – Consolidated Rules of Practice OSHA contests go before the Occupational Safety and Health Review Commission once the employer files a written notice of contest within 15 working days.6Occupational Safety and Health Administration. 1903.17 – Employer and Employee Contests Before the Review Commission
Court Review
If the administrative route does not resolve it, you can usually take the dispute to court. For IRS deficiency notices, the Tax Court is the primary venue within that 90-day window. If you choose not to petition the Tax Court, you can still contest the deficiency by paying the assessed amount and suing for a refund in a U.S. District Court or the U.S. Court of Federal Claims within two years.13Internal Revenue Service. 4.8.9 Statutory Notices of Deficiency
What Ignoring a Statutory Notice Actually Costs
This is where people get into serious and avoidable trouble. Consequences escalate in stages.
Growing Financial Penalties
Penalties accrue and interest compounds. The FTC can seek civil penalties up to $50,120 per violation against companies that received a notice of penalty offenses and continued the prohibited conduct.16Federal Trade Commission. Notices of Penalty Offenses OSHA penalties for failing to correct a cited violation can reach $16,550 per day the violation continues.7Occupational Safety and Health Administration. 1903.15 – Proposed Penalties Under certain federal pension and benefits statutes, a person who fails to provide a required notice can face $100 per day.17Office of the Law Revision Counsel. 29 USC 1452 – Penalty for Failure to Provide Notice
Seizure of Property and Income
Tax agencies have aggressive collection tools. Ignore a CP504 and the IRS can levy wages, bank accounts, and your state tax refund, and file a Notice of Federal Tax Lien against your property.4Internal Revenue Service. Understanding Your CP504 Notice A federal tax lien attaches to all your property, including real estate, personal property, and financial assets, and makes selling or borrowing against your property very difficult.18Internal Revenue Service. Understanding a Federal Tax Lien
Loss of the Right to Contest
The worst consequence is losing the ability to fight back at all. Fail to petition the Tax Court within 90 days of a deficiency notice and the IRS assesses the full amount, with no further Tax Court review available.2Office of the Law Revision Counsel. 26 USC 6213 – Restrictions Applicable to Deficiencies; Petition to Tax Court An OSHA citation uncontested for 15 working days becomes a final order with no further right of review. Every statutory notice has a built-in expiration on your right to respond, and once that date passes, good reasons for the delay rarely reopen it.
If You Have Limited English Proficiency
Federal agencies and organizations that receive federal funding are required to take reasonable steps to provide meaningful access to their communications and services for people with limited English proficiency, under Title VI of the Civil Rights Act of 1964 and Executive Order 13166.19U.S. Department of Justice.
